De acuerdo a la información documental con la que cuenta este Centro de Derechos Humanos el 4 de diciembre de 2011, en Banavil, Tenejapa, un grupo de integrantes del Partido Revolucionario Institucional (PRI) agredieron con armas de fuego a cuatro familias que son simpatizantes del Ejército Zapatista de Liberación Nacional (EZLN).

Editorial (“Don’t chuck it, share it”)

Boca en Boca [“by word of mouth”] is an independent news sheet that aims to spread news of what is happening in the organized communities of Chiapas. It aims to oppose the strategy of the government and generate solidarity by providing summaries and extracts from the communities’ news releases. In the long term, the goal is to distribute it among the indigenous communities in their own language.

No to “the Cancun of Chiapas” at the Agua Azul waterfalls

Adherents to the Other Campaign from the Ejido San Sebastian Bachajón deny the official story from the delegate of the Chilón government concerning the clashes which occurred on the 1^st November 2011, “due to the dispute about the lands of Rancho El Vergel, in the municipality of Citalá, where three people pretending to be Zapatistas lost their lives; they were badly disguised by C Carmen Aguilar Gomez and his son, the faithful friend of the  government delegate and the ejidal commission”.

They repeat that “on several occasions we have publicly denounced C Carmen Aguilar Gomez and his son, who were expelled from the organization of the Other Campaign last year, and also from the organization. At no time have we said that we would take that ranch”.

They reaffirm “that these are the same people who participated in the violence last February at Agua Azul. It is clear that this comes from the government and that these people have nothing to do with the organization and that at no time has the organization had anything to do with the occupation of any ranch”.

On the 26th November, through a second press release, they recalled the actions of these same groups and leaders “with the intention of taking advantage of our natural wonders and turning them into the Cancun of Chiapas”.

Las Abejas (the Bees) defend and care for their hive

“The Civil Society Organization, Las Abejas of Acteal, objects strongly to the interview conducted by Eugenio Bermejillo, director of the organization “Red de Comunicadores Boca de Polen” (Pollen´s Mouth Communicators Network) …, with Sebastian Gomez Perez, who he introduced as “President of the Board of Directors of the Civil Society Organization Las Abejas“. In this regard, we wish to explain and to remind you that this is not the first time this group has passed itself off as the organization Las Abejas“.

In 2008, a group of “leaders” of Las Abejas separated from our organization, and as a result we now announce publicly that “this group of people can in no way speak on behalf of the Civil Society Organization Las Abejas“.                                                                                “The community radio project Radio Chanul Pom … no longer belongs to Las Abejas”.             The name of Las Abejas has “on various occasions been used in marches, in the development of projects or assistance programmes from the bad government, and as many times we have protested and publicly asked this group to find another name for their organization”.

“The aim of this group in using the name of Las Abejas, is to gain power for electoral motives, economic benefits and a special deal with the government”.

Even though the names sound the same, “in reality our goals, mission, vision, philosophy and aims have nothing in common”.

“It is very clear that Eugenio Bermejillo intends to promote confusion around the organization Las Abejas and to feed the counterinsurgency policy, so that the Acteal massacre may be forgotten, and its material authors and masterminds remain unpunished”.

During their march on the 24^th of November, el Pueblo Creyente (the Believing People) and the base ecclesiastical communities denounced:

“The lack of strong action by the relevant authorities who control the trade and consumption of alcohol and drugs and the opening of bars, brothels and other places which do so much damage to our communities”

“The potential threat posed by mining concessions”                                                     “The use of our national resources to drive the ambitious  projects of transnational corporations”                                                                                                       “False environmental policies …, the seizure of our lands as a commodity to mitigate the effects of climate change and allow the continuation of a development model that refuses to reduce polluting emissions”

“The noxious effects of projects that lead to cultural change and the abandoning of food production, in order to promote mono-cultivation for industry”

“The risk posed to our native seeds, the acceptance of GM crops and the ambiguous attitude of government officials and agencies towards the big branches of  industry”.

“We re-emphasize our solidarity with the Movement for Peace with Justice and Dignity, and with the victims of the violence which has erupted in many states of the country in recent years. In particular we urge a change in policy to give justice to our brothers and sisters who are unjustly imprisoned. At the same time we join with other peaceful struggles in defence of Mother Earth, land and life that are being carried out in other states and throughout the world”.

13^th November – MOCRI-CNPA-MN clarifies a note in the newspaper Cuarto Poder concerning the demand for punishment of the murderers of Martha Gómez Pérez.

18th November – Gunmen attack and imprison adherents to the civil resistance against high electricity rates, Teopisca.

25^th November – Women of the communities of Chiapas march, “the Mexican government is required to guarantee our right to live a life without violence”.

Political Prisoners, 40 days on Hunger Strike

Here we report on a series of events which marked, this November, the campaign for the release of political prisoners in Chiapas, beginning with a hunger strike, which was accompanied by their families, who joined them by setting up an encampment in San Cristobal de Las Casas.

In a letter of 2^nd November, Alfredo López Jiménez and Rosa López Díaz from ´Solidarity with the Voice of Amate´ report the death of their son Natanael López López, “who was born 4 years ago with cerebral palsy, without movement in his whole body, among other diseases he was suffering. The cause of this was the torture that was done to my wife when we were arbitrarily detained in 2007, and she was 4 months pregnant”. “He died through medical negligence as treatment was denied to my family “.

On the 7^th of November, the day the hunger strike of the prisoners ended, along with the encampment of the families, Enrique Gómez Hernández from ´Solidarity with the Voice of Amate´ denounced, “since the 8^th of October, our family started a protest, stating that the requests they made to the government exactly 30 days ago …  the government has refused to intervene in the matter and completely ignored us, even our families, no matter what our families are suffering and leaving aside the promise that he signed when he made his political campaign  and now that he is in power he does not know anyone and yet he is still so proud to announce in the media: “actions, not words”.

“But it seems the government prefers to tell us lightly that we cannot benefit, much less gain our freedom, without considering the state of health of the compañeros in CERSS  No. 5, which is very delicate as they are between life and death, due to the action they have undertaken (of the hunger strike) … and the government does not care, it has ignored us completely. ”

At the end of the hunger strike a letter of thanks was sent to individuals and organizations who supported the action in various parts of Mexico and the world, “do not be discouraged, do not weaken, do not be disturbed, but be more courageous, strong, brave and united in all things and with us. From here in Chiapas, southeastern Mexico, in the trenches of our resistance we will persist and resist”.

On the 15^th November,”* Andrés Núñez Hernández * and * José Díaz López * were released, both members of the organization ´Solidarity with the Voice of Amate´. Andrés and José, after 9 years and 8 months of wrongful imprisonment, were released under the legal concept of a suspended sentence”.

“Today the following remain hostages of the bad government of Felipe Calderón and Juan Sabines: the compañer@s Alfredo Lopez Jimenez, Alejandro Diaz Sántiz, Pedro López Jiménez, Juan Díaz López, Rosario Díaz Méndez and Rosa López Díaz in CERSS No. 5 in San Cristobal de Las Casas, Enrique Gómez Hernández held in CERSS No. 14 El Amate, Juan Collazo Jimenez held at CERSS No. 6, and compañero Alberto Patishtan Gómez held captive in CEFERESO N°8 in Guasave, Sinaloa,  (who was transferred during the strike as a punishment). All have been detained arbitrarily, have suffered torture and violations of their fundamental human rights and therefore have staged a hunger strike and fast of 39 days, which has been ignored and repressed by the authorities”.

On the 14^th of November, a member of the ´Voice of Amate´, Rosario Díaz Méndez, denounced “the medical deficiencies that are suffered in state prisons have led to complications in various illnesses that are easy to cure, especially in CERSS No. 5 which suffers much medical malpractice”. “I suffer from an illness called epilepsy, and I have been suffering from nausea for two years”. A similar complaint about the lack of medical attention was made by Alfredo Lopez Jimenez on the 15^th November.

Even during the hunger strike it was announced that “the authorities of CERSS No. 5 in San Cristobal de Las Casas, have on several occasions refused entry to health personnel who had come with the intention of visiting” our prisoner compañeros, who were already in a serious state of health.

Tenosique, Tabasco, the forgotten frontier

On the 23^rd August last, the people of the Nueva Esperanza community, Zone of El Peten, Guatemala, were displaced through a violent eviction by the army of their country. They are now refugees on the border next to the community of Nuevo Progreso, in the Municipality of Tenosique, Tabasco, “where they have been surviving with great difficulty for more than eighty days, in extremely precarious conditions which endanger their health and integrity”.

They also “are being threatened, and unsupported information is being disseminated about them, such rumours increase the vulnerability of their condition”, generating “acts of exclusion, discrimination and xenophobia against them”.

“The governments of Guatemala and Mexico are not providing the humanitarian assistance which they are obliged to provide for displaced persons and refugees”.

“Various organizations in Mexico, forming a Civil Observation Mission, reported in October with great difficulty the critical situation in which they found nearly three hundred people, of whom 115 are children or adolescents”. “The Mission documented, as well as the inhumane conditions, charges against the displaced population”, which were not supported by the evidence, “but were supported by the authorities in Guatemala”.

“During the first days of November we learned of a letter which the residents of Nuevo Progreso, Tenosique, had sent to the authorities accusing ´the people´ of committing excesses, getting drunk, beating their wives and bearing arms”. “We are concerned that an authority in Mexico or Guatemala may be contributing to the spread of rumours that may cause or lead to discrimination, or violent responses”.

They request “the Mexican government to give effect to the principles of solidarity, hospitality and protection, which should govern immigration policy”, “the Government of Guatemala was asked to facilitate dialogue, guaranteeing that the community of Nueva Esperanza will have appropriate and consistent standards of human rights, and their lands, homes, and in general all conditions for a dignified life restored to them”.

Follow-up information

14th November –  5 years after the massacre of Viejo Velasco, Ocosingo, (which was a support base of the EZLN*, in the municipality of Vicente Guerrero) “The material and intellectual authors (the perpetrators and instigators) of the massacre have not been investigated, much less brought to trial; however, survivors of the event and people from surrounding communities who provided humanitarian assistance were identified by the Attorney General of the State of Chiapas as responsible for the slaughter”.                                     *not at the time of the massacre

Acteal denounces the countless cases of impunity in Chiapas. “We must not be afraid to demand respect for human rights, we must speak out. We know that as human beings we are suffering very much, but it is not only us who suffer, but also our mother earth”.

Protestan por agresión a fotógrafo de La Jornada

Ante el temor de que los detenidos sufrieran maltrato e incluso agresiones sexuales en el camino a la comandancia, como ocurre con frecuencia en estas tierras, el fotógrafo pretendía dar fe del estado físico de los detenidos antes del traslado. Uno de los policías lo golpeó con fuerza en el ojo y la cámara, y luego le causó daño en el hombro derecho y el cuello. Al arribo de una patrulla municipal, los detenidos fueron liberados.

Queremos externar nuestra protesta, señalando la responsabilidad de la alcaldesa Cecilia Flores en la actuación de sus subordinados. Exigimos la reparación de los daños físicos y materiales a Moysés Zúñiga y el respeto a nuestras tareas periodísticas.

EL PASADO 2 DE FEBRERO DE 2011, UN GRUPO DE PERSONAS ARMADAS ENCABEZADAS POR CARMEN AGUILAR GÓMEZ PRIMERO Y MIGUEL RUIZ HERNÁNDEZ, INGRESARON A LA CASETA DE COBRO DE ACCESO DE LAS CASCADAS DE AGUA AZUL QUE EN ESE MOMENTO ESTABA ADMINISTRADA POR NUESTRA ORGANIZACIÓN, Y DESALOJARON VIOLENTAMENTE A NUESTROS COMPAÑEROS QUE ESTABAN REALIZANDO SUS TRABAJOS DE CONSTRUCCIÓN DE UNA OFICINA, LOS GOLPEARON Y ROBARON TODO EL MATERIAL DE CONSTRUCCIÓN Y DINERO EN EFECTIVO PRODUCTO DE LOS INGRESOS AL CENTRO ECOTURÍSTICOS. ESTAS PERSONAS FUERON FINANCIADAS POR EL ACTUAL PRESIDENTE DE LA FUNDACIÓN VERDE ECOLOGISTA LEONARDO GUIRAO AGUILAR POR UNA CANTIDAD DE 60,000 PESOS, ESE ES EL GRAN EJEMPLO QUE COMO AUTORIDADES DE ESTE MAL GOBIERNO PUEDEN FINANCIAR LA MUERTE, LA VIOLENCIA Y EL DESPOJO EN NUESTRAS TIERRAS. POSTERIORMENTE  NUESTRA ORGANIZACIÓN INTENTÓ RECUPERAR LA CASETA DE COBRO PERO INMEDIATAMENTE LA POLICÍA FEDERAL Y ESTATAL PREVENTIVA INGRESARON A RESGUADAR A LOS AGRESORES Y A TOMAR EL CONTROL DE LA CASETA Y EL BANCO DE GRAVA. EL 3 DE FEBRERO SE INTENSIFICÓ LA PRESENCIA POLICIACA Y MILITAR EN NUESTRO TERRITORIO Y FUE DONDE DETUVIERON ILEGALMENTE A 117 COMPAÑEROS QUE FUERON TRASLADADOS A PALENQUE, CHIAPAS PARA FABRICARLES DELITOS Y UTILIZANDO COMO TESTIGOS FALSOS A LOS AGRESORES QUE NOS ATACARON VIOLENTAMENTE. DÍAS DESPUES FUERON LIBERADOS 107 COMPAÑEROS, DÍAS DESPUÉS LIBERARON A OTROS 5 COMPAÑEROS, LOS ÚLTIMOS 5 COMPAÑEROS PRESOS POLÍTICOS PERMANECIERON SECUESTRADOS 5 MESES Y 20 DÍAS EN EL PENAL DE PLAYAS DE CATAZAJÁ, CHIAPAS PERO GRACIAS A LA COLABORACIÓN Y APOYO DE LA SOLIDARIDAD NACIONAL E INTERNACIONAL SE LOGRÓ LA LIBERACIÓN DE TODA ESTA VIOLENCIA Y ESTA INJUSTICIA PROVOCADA POR EL GOBIERNO Y AVALADA POR LAS AUTORIDADES EJIDALES OFICIALISTAS Y POR EL CONSEJO ESTATAL DE DERECHOS HUMANOS.

PERO NO HAN LOGRADO SU OBJETIVO PORQUE NUESTRO PUEBLO SIGUE RESISTIENDO LA REPRESIÓN Y LA CAMPAÑA DE DESPRESTIGIO Y DIFAMACIÓN EN CONTRA DE NUESTRA ORGANIZACIÓN QUE EL MAL GOBIERNO REALIZA A TRAVÉS DE LOS MEDIOS DE COMUNICACIÓN QUE  NO DIFUNDEN LA REALIDAD SINO LO QUE EL GOBIERNO LES ORDENA PUBLICAR. DE ESTA MANERA EL GOBERNADOR CHARLATAN JUAN SABINES GUERRERO QUE SE DICE DEFENSOR DE DERECHOS HUMANOS SIMULÓ PÚBLICAMENTE CONVOCAR A LA FIRMA DE UN CONVENIO DE PAZ SOCIAL ENTRE LAS PARTES, SIN EMBARGO NUESTRA ORGANIZACIÓN NO PARTICIPÓ EN ESE CONVENIO PORQUE ES EL MISMO GOBIERNO QUE NOS ESTÁ DESPOJANDO Y SOLO A TRAVÉS DE LA AMENAZA Y EL CHANTAJE NOS QUERÍA OBLIGAR A PARTICIPAR EN ESE CONVENIO, PARA QUE ASÍ SALIERAN LIBRES NUESTROS COMPAÑEROS QUE ESTABAN SECUESTRADOS EN LA CARCEL. EN ESE CONVENIO EL COMISARIADO OFICIALISTA FRANCISCO GUZMÁN JIMÉNEZ ENTREGÓ AL GOBIERNO LA PROPIEDAD DE NUESTRAS TIERRAS PARA LA CONSTRUCCIÓN DE UNA CASETA DE COBRO, UN CENTRO DE RESPUESTA DE EMERGENCIAS Y PROTECCIÓN CIVIL Y LA PERMANENCIA DE LA POLICÍA ESTATAL PREVENTIVA TODO ESTO SIN CONSENTIMIENTO NI AUTORIZACIÓN DEL PUEBLO.

CONTRA ESTE CONVENIO Y DESPOJO NUESTRAS TIERRAS, EL 4 DE MARZO DE 2011 NUESTRA ORGANIZACIÓN  INTERPUSO EL AMPARO 274/2011 ANTE EL JUEZ SÉPTIMO DE DISTRITO EN TUXTLA GUTIÉRREZ, CHIAPAS Y SOLICITÓ LA SUSPENSIÓN DE PLANO PARA OBLIGAR AL MAL GOBIERNO A NO SEGUIR  AVANZANDO CON EL DESPOJO. Compañeros y compañeras, el día de hoy nuestro corazón se siente con más fuerza al compartir nuestra palabra con otros pueblos que están defendiendo la madre tierra de quienes solo quieren hacer negocio con ella y derramar la sangre de nuestros pueblos a través de la represión.

Para los hombres y mujeres de maíz la madre tierra representa lo más hermoso que Dios Padre y Madre ha creado como herencia para nuestros hijos y nietos, es el regalo más sagrado que nos permite hacer nuestra milpa, enterrar a nuestros muertos, prender nuestra vela y tomar el agua que nos da vida.

Nuestros abuelos y abuelas con mucho sufrimiento y esfuerzo lograron resistir la esclavitud y explotación de la invasión española y después de las fincas cafetaleras de extranjeros y mexicanos ricos que nos despojaron durante muchos años de nuestro territorio. La lucha política y armada de nuestros antepasados dieron el fruto que nosotros seguimos defendiendo hasta la fecha, que son nuestras tierras ejidales de dotación y ampliación de las cuales contamos con toda la documentación agraria, que ampara y protege nuestro derecho legítimo y legal para gobernar de manera autónoma nuestro territorio como pueblo indígena Ch´ol.

Durante muchas décadas el mal gobierno ha venido haciendo grandes injusticias en contra de nuestro pueblo, a través del despojo, la discriminación, el hostigamiento, y la constante amenaza de expropiar 130 hectáreas de nuestro patrimonio.

En la época de la Revolución Mexicana recuperamos las tierras que estaban en manos de los finqueros extranjeros y mexicanos ricos, muchos de ellos salieron huyendo a sus lugares de origen. En 1922 hicimos la solicitud formal a las autoridades agrarias para que se nos reconociera la posesión y propiedad de nuestras tierras. Fue así que el 30 de julio de 1934 se emite la resolución presidencial que nos reconoce la propiedad de 5,405.78 hectáreas de dotación, de las cuales 2,938 hectáreas fueron expropiadas de terrenos nacionales y 2,466 hectáreas fueron expropiadas a la finca Jonopá de la Pensilvania Plantation Company.

En esos tiempos la cabecera municipal se encontraba ubicada en el ejido vecino de Petalcingo, pero por causa de una epidemia las autoridades del Ayuntamiento municipal se trasladaron de manera provisional a nuestro pueblo de Tila. Muy al comienzo de su llegada del ayuntamiento a nuestro pueblo no había mucho problema, porque las autoridades eran elegidas por la Asamblea del pueblo y no había partidos políticos, por eso es que las autoridades trabajaban para el pueblo y una vez terminando sus cargos regresaban a trabajar su tierra. Cuando los partidos políticos empezaron a tomar los cargos del Ayuntamiento empezó más duro la discriminación y el despojo de nuestras tierras. Los presidentes municipales venían de fuera, no eran indígenas como nosotros sino mestizos que nos desprecian y que son originarios de otro lugar que solo vienen a enriquecerse a costa de nuestro trabajo y de nuestra madre tierra. A pesar de todo este mal trato, cuando el ejido estaba realizando los trabajos de posesión y deslinde de la dotación ejidal las autoridades enviaron comisión tres veces para pedir al presidente municipal Lic. Rafael Constantino Martínez que se presentara en casa ejidal para que dijera la superficie que iba a necesitar el ayuntamiento para su administración, pero las tres veces esta persona contestó que él no se junta con indios pata rajadas. De esta manera el Acta de Posesión y deslinde de la Dotación ejidal así como el plano de ejecución no contempló superficie para la zona urbana del ejido, ni tampoco para el fundo legal.

Al darse cuenta el Ayuntamiento que no tenía tierra dentro de nuestro ejido donde ejercer su administración, comenzó a alterar nuestra documentación agraria con el respaldo y complicidad del Cuerpo Consultivo Agrario, por lo que en 1966 en sesión colegiada decidieron agregar una nota a nuestro plano definitivo que señaló que 130 hectáreas de nuestra dotación salen de la propiedad ejidal y que pasa a manos del ayuntamiento como fundo legal. Es por eso que interpusimos el amparo 890/1977 ante el Juez Primero de Distrito en Tuxtla Gutiérrez el cual ganamos en 1984 y se declaró inconstitucional la modificación a nuestro plano, pero quedó como letra muerta porque el Cuerpo Consultivo Agrario dio cumplimiento al amparo hasta 1994, gracias al levantamiento armado del 1 de enero de 1994 del Ejército Zapatista de Liberación Nacional, el punto de acuerdo que modificaba nuestro plano quedó insubsistente.

En 1980 se da otro acto de despojo, cuando el entonces Gobernador del Estado de Chiapas Juan Sabines Gutiérrez solicitó al Congreso del Estado la publicación del decreto expropiatorio número 72 en el que se declara que por causa de utilidad pública se decreta como fundo legal 130 hectáreas de nuestra dotación y utilizaron como fundamento del decreto 72 la modificación a nuestro plano definitivo que hizo en 1966 el Cuerpo Consultivo Agrario, violando el artículo 2, 14, 16 y 27 fracción VIII, a) de la Constitución Política de los Estados Unidos Mexicanos. En contra de este decreto 72 presentamos el amparo 259/1982 ante el Juez Primero de Distrito en Tuxtla Gutiérrez, mismo que se resolvió después de 28 años de estar archivado, por lo que en diciembre de 2008 se declaró a favor de nuestro ejido que el decreto 72 es inconstitucional y se ordenó al Ayuntamiento de Tila, Gobernador del Estado, Congreso del Estado y Registro Público de la Propiedad y del Comercio que se nos restituya en la administración de las 130 hectáreas de nuestro territorio que han sido despojadas por esos malos gobiernos. Hasta la fecha estas autoridades se han negado a dar cumplimiento a lo ordenado por la sentencia de amparo y quieren obligarnos a recibir una indemnización económica, pero ante la negativa del ejido a recibir un pago por nuestras tierras, el expediente 1302/2010 se encuentra en estos momentos en manos del Pleno de la Suprema Corte para resolver si la administración de las 130 hectáreas regresa a la Asamblea General del ejido Tila o queda con el ayuntamiento del municipio de Tila. La Asamblea General del ejido Tila presentó diversas Actas de Asamblea, una de ellas con mas de 4,000 firmas, dirigida a la Suprema Corte exigiendo el respeto a nuestro territorio y autonomía, asimismo dando a su conocimiento que los pobladores que compraron ilegalmente tierras ejidales serán respetados en sus posesiones porque fueron engañados y ahora se sujetarán a nuestro Reglamento Interno y también se solicitó la reubicación de las oficinas del Ayuntamiento municipal de Tila en otro lugar, ya que este ha sido durante muchos años el generador de la violencia y financiador del grupo paramilitar Paz y Justicia, autor de los crímenes de lesa humanidad en la zona baja de Tila en la época más fuerte del conflicto armado en Chiapas.

De ante mano sabemos que la Suprema Corte no ha tomado carta en el asunto de darle la ejecución al amparo y respetar nuestro derecho como pueblo indígena; le van a dar más atención a las contiendas electorales presidenciales y gobernadores, permitiendo que los malos gobiernos nos sigan despojando, amenazando y hostigando, porque en realidad no les importa a los Ministros hacer la justicia y solo protegen a los poderosos que si pueden comprar su justicia.

Nuestra tierra es sagrada y la consideramos como tierra recuperada por nuestros abuelos y abuelas, basta ya de tanta injusticia, despojo y represión por la defensa de nuestra madre tierra que es el futuro de nuestros hijos y nietos del ejido Tila. Seguiremos en la defensa de nuestro pueblo y territorio hasta la victoria siempre! Ánimo compañeros y compañeras, el pueblo unido jamás será vencido!

We denounce two years of impunity in the case of human rights defenders Margarita Guadalupe Martínez and Adolfo Guzmán

Two years have passed since members of the Chiapas state attorney general’s office (PGJE), specifically the District Office of the Border Mountain zone (FDFS), unlawfully entered our home in Comitán, Chiapas, committed abuse of authority and tortured the four members of our family. A formal complaint was made regarding these injustices at the Special Office for Protection and Attention to Human Rights NGOs (FEPAONGDDH), yet in spite of the time that has elapsed, neither the Special Office nor the Chiapas state government has done anything to shed light on what happened and they continue dragging their feet in order to cover up government officials and prevent the truth from coming to light.

Since legal proceedings of this case began, we have received death threats six times, Margarita Martínez has been kidnapped and tortured twice, first on February 25, 2010 (36 hours before the legal re-enactment of what occurred), then on November 24, 2011. Formal public complaints were filed on each occasion.

Following the kidnapping of Margarita on February 25, 2010, the Inter-American Commission on Human Rights (ICHR) called on the Mexican army to protect our family and decreed protection measures for us, consisting of police guards to be assigned by the Chiapas state government, from a “special corps” from the Secretary of Public Security and Citizen Protection (SSyPC). We were forced to accept these measures in light of the imminent risk and vulnerability we faced.

Yet protection measures have not helped our case nor have they produced a less stressful situation. In fact, Margarita’s kidnapping in November, 2010 happened while being accompanied by a police guard and in October of this year we received an anonymous death threat at our home, supposedly protected by the SSyPC,.

We believe that the ineffectual actions of the judicial branch of the state of Chiapas and its complicity with the parties we have sued have to do with the following circumstances:

First, regarding the delays in obtaining a verdict: FEPAONGDDH divided the case into three separate events, supposedly to carry out a better investigation, i.e. 1) illegal entry with abuse of authority, torture (which authorities have dropped); 2) threats, a charge aggravated by the fact that it was a death threat; 3) Kidnapping, torture and rape. Charges stemming from these three events were filed with FEPAONGDDH, but only the first has been formally admitted and prosecuted, and even then the accusation of torture was omitted.

Second, dealing with the reclassifying of crimes, a procedure we have questioned: FEPAONGDDH alleges that due to a lack of proof, the charge of torture cannot be prosecuted, in spite of the fact that a UN-certified psychologist on torture carried out an evaluation in accordance to the standards outlined in the Istanbul Protocol, and found that all members of our family had been tortured.

Third: the protection measures requested by the ICHR and implemented by the government of Chiapas have hardly ensured security, since, as noted before, two very serious crimes were committed even while our family was receiving police protection.

The Attorney General of Chiapas, Raciel López Salazar, and the Governor of the State, Juan Sabines Guerrero, have not contributed to clearing up these matters, in spite of the request by the ICHR, thus clearly showing a lack of justice and accountability in prosecuting efficiently and objectively the crimes committed by state officials under their authority.

Given the above, we hereby lodge a protest against the state’s breach of duty to carry out a prompt and impartial investigation. Two years have passed and the facts have yet to be investigated fully nor has a verdict been handed down against the accused parties. This points to a clear dereliction of duty of the Mexican government, and particularly the government of Chiapas, and underscores the total lack of guarantees for human rights defenders.

We therefore demand the following from the governments of Chiapas and Mexico:

• Full implementation of the ICHR’s protection measures (decree 52-10) in a efficient and professional manner.
• Guarantees for the lives and physical and emotional wellbeing of all members of our family.
• Public officials implicated in the serious accusations that have been filed (illegal entry, abuse of authority, death threats, torture, kidnapping and rape) should be suspended from duty until the matter is legally resolved, insofar as those involved have used their government posts to avoid prosecution.
• Those officials responsible for the crimes committed should be prosecuted and sentenced for the violations of human rights that occurred.

MOVILIZACIÓN GENERAL: Lunes 7 de noviembre, Tuxtla Gutiérrez

El pasado 29 de septiembre nuetsr@s compañer@s pres@s de La Voz del Amate, Solidarios de la
Voz del Amate y Voces Inocentes, recluidos en el CERSS 5 de San Cristóbal de las Casas, se declararon
en huelga de hambre y ayuno indefinido para exigir su libertad inmediata e incondicional. El día 3
de octubre se suman a esta acción dos presos de los Solidarios de la Voz del Amate recluidos en el
CERSS No. 14 el Amate y en el CERSS N° 6 de Motozintla, quienes se declaran en ayuno de 12 horas
diarias. El día 28 de octubre, los ayunantes Andrés Núñez y Juan Collazo anuncian públicamente
que se suman a la huelga de hambre total. En apoyo a esta acción, los familiares de l@s pres@s se
encuentran en plantón indefinido en la plaza catedral de San Cristóbal de Las Casas.

A la fecha de hoy el gobierno del estado no ha dado ninguna respuesta a dichas exigencias y se
ha dedicado a hostigar y reprimir esta acción de protesta digna y legitima de l@s compañer@s,
amenazando en varias ocasiones a l@s huelguistas, trasladando al Profesor Patishtan a un penal
federal ubicado en Sinaloa y prohibiendo la entrada a personal de salud en el CERSS 5 de San
Cristóbal de Las Casas.

A más de un mes de iniciada la huelga de hambre, el estado de salud de l@s compañer@s se va
deteriorando cada vez más, poniendo en riesgo inminente su vida. Sin embargo su decisión es
más firme que nunca y su esperanza incansable. No nos podemos quedar callados frente a tantas
injusticias y represión de parte del mal gobierno porque si nos tocan a un@s, nos tocan a tod@s!

Convocamos a tod@s los individuos, colectivos, organizaciones independientes que caminan abajo
y a la izquierda a una movilización general el LUNES 7 DE NOVIEMBRE DE 2011, en la ciudad de
Tuxtla Gutiérrez, para exigir la libertad de nuetsr@s compañer@s pres@s en lucha.

Nuestra solidaridad es necesaria para que, a pesar de las adversidades provocadas por los grupos paramilitares, los compañeros y compañeras zapatistas resistan contra estas agresiones provenientes de los tres niveles del gobierno.

Acopio Urgente Contra la Represión y el Despojo a las Comunidades Indígenas Zapatistas

Desde el levantamiento de 1994, los compañeros y compañeras zapatistas no han dejado de sufrir el acoso y represión por parte de los gobiernos en turno; en algunas épocas con mayor o menor intensidad. Sin embargo, en este gobierno sangriento de Felipe Calderón Hinojosa del Partido Acción Nacional, a nivel federal, y del farsante de Juan Sabines Guerrero del Partido de la Revolución Democrática, a nivel estatal, las agresiones hacia las comunidades indígenas zapatistas han ido escalando niveles de violencia ¡ya insoportables!

En Septiembre del 2010, la comunidad de San Marcos Avilés, sufrió un terrible desplazamiento ocasionado por “pobladores” afiliados a los partidos políticos del PRI, PAN, PRD y PVEM; quienes sacaron de forma violenta, a hombres, mujeres, niños y niñas de sus casas, obligándolos a vivir en el monte, sin agua ni alimentos durante 33 días. Tras su retorno, el hostigamiento, acoso y agresiones en contra de las BAZ de San Marcos Avilés, no ha cesado, intentando incluso un segundo desplazamiento. Lo anterior ha dificultado la colecta de sus cosechas o el trabajo en sus parcelas, lo que genera una situación de emergencia alimenticia y sanitaria que está provocando terribles estragos al interior de la comunidad.

Desde el pasado 7 de septiembre, la comunidad de San Patricio, municipio autónomo de la Dignidad, está siendo amenazada por el grupo paramilitar “Paz y Justicia” con entrar a invadir y desalojar a la comunidad bajo el pretexto de que no están pagando el impuesto predial, agregando que si no entregan las tierras recuperadas, “entrarán a masacrarlos a todos”. Tienen cercada a la población no dejándolos salir en busca de alimentos, les han matado animales, les destruyen sus cosechas, intimidan a las mujeres y a los niñ@s, han construido pequeñas casas en tierra de trabajo de los compas, es decir, hay una ocupación de la tierra recuperada y está avanzando poco a poco.

Por todo ello, se hace un llamado de EMERGENCIA a todos los adherentes a la Sexta Declaración de la Selva Lacandona, a la Zezta Internacional y a la población en general de buen corazón, abajo y a la izquierda, a que se solidaricen con las comunidades indígenas zapatistas, a no permitir su exterminio.
