Comuneros de Juchitán de Zaragoza, en el istmo de Tehuantepec, Oaxaca, lograron la suspensión del proyecto eólico Gunaa Sicarú, de la empresa Energies Nouvelles Group Energía de Francia (EDF), una de las más importantes a nivel mundial en el sector energético.
Los comuneros argumentan que se pretende construir el parque en tierras comunales sin la autorización del pueblo indígena que vive en Juchitán y sus cinco anexos: Santa María Xadani, Unión Hidalgo, Chicapa de Castro, Espinal y La Ventosa.

Un juicio de amparo fue interpuesto por los comuneros en septiembre de 2020. El abogado del Congreso Nacional Indígena (CNI), Carlos González, quien lleva el caso, explica que el amparo fue interpuesto en el sexto juzgado de distrito, en Salinas Cruz, uno de los dos juzgados de la región que tienen competencia para este tipo de asunto. “Cuando algún grupo de personas, algún colectivo, alguna población, solicita algún amparo en contra de estas empresas, de manera sistemática, [en estos juzgados se] niega la suspensión de los actos”, explica.
Eso fue lo que pasó con los comuneros de Juchitán. El juzgado sexto de distrito negó a los comuneros que se suspendiera las actividades de la empresa hasta que, por lo menos, se resolviera el juicio de amparo interpuesto. Entonces los comuneros acudieron al Primer Tribunal Colegiado en Materias Civil y Administrativa del Décimo Tercer Circuito, con sede en San Bartolo Coyotepec, donde interpusieron una queja y les fue concedida la suspensión.
“(…) Que las autoridades responsables se abstengan de ejecutar actos que tengan por objeto privarla total o parcialmente, en forma temporal o definitiva, de la propiedad, posesión o disfrutar de las tierras de uso común con motivo de los trabajos relativos a la construcción de un campo eólico denominado Gunaa Sicarú”, declaró el colegiado por unanimidad.
El juicio de amparo fue interpuesto por los comuneros que viven en el anexo Santa María Xadani. “Se quiere construir el parque en terrenos de otros anexos, Unión Hidalgo y La Ventosa. Por ser todo Juchitán terreno comunal y de uso común entonces les reconoce este interés legítimo”, explica el abogado.
Más allá de Juchitán
En 1964, Juchitán obtuvo una resolución presidencial en la cual se reconocía sus tierras como propiedad comunal. En esta resolución se reconoce Juchitán como la cabecera, junto con sus anexos.
“Con el tiempo, el gobierno buscó sacar de la propiedad comunal algunas franjas de tierras, otorgando títulos individuales. Eso provocó que la comunidad se organizara y que iniciara una lucha muy importante. Eso lleva a la intervención del gobierno y del ejército en contra de la comunidad, entre 1975 y 1977. La represión fuerte llevó al desmoronamiento de parte de esta organización”, explica el abogado. Como resultado hasta el día de hoy Juchitán no cuenta con representantes agrarios.
Sin embargo, en la decisión judicial, se reconoce el “interés legítimo de los comuneros para acudir en defensa de los derechos colectivos y del total de la superficie de los terrenos de la comunidad agraria de Juchitán”, sostienen los indígenas en un comunicado.
Este reconocimiento es histórico para Juchitán, argumenta González. “Juchitán ha estado indefenso para defender sus bienes agrarios, justamente porque no posee representante de bienes comunales. Cuando ha interpuesto amparos generalmente se hace por cuestiones ambientales, de afectación de la salud. Pero en este caso estamos planteando una afectación sustantiva a la tierra, al territorio. Por primera vez en muchos años se logra un triunfo”, afirma González.
El hecho de que en la decisión judicial se otorgó a un grupo de comuneros legitimidad para actuar y para defender los intereses colectivos de la comunidad, sin una representación comunal, abre una importante línea en la defensa del territorio en todo México, según González. “Esta decisión puede sustentar las luchas de multitud de comunidades que están en esta situación en todo el país, incluso casos en los cuales las comunidades tienen comisariados de bienes comunales pero que están a favor de los proyectos”, explica.
La resolución transciende para múltiples casos de comunidades o de grupos de comuneros y ejidatarios que “defienden las tierras de sus pueblos con todo encima de ellos, con el gobierno federal, gobierno del Estado, gobierno municipal, las organizaciones corporativas, los medios de comunicación en contra”, agrega González.
Sobre el proyecto
De acuerdo a datos oficiales, proyecto Gunaa Sicarú fue otorgado en la 2ª subasta eléctrica realizada en el 2016 por el Centro Nacional de Control de Energía (CENACE) a Energía Eólica Oaxaca, asociada de Energies Nouvelles Group como proyecto verde y consiste en el diseño, construcción, equipamiento, instalación, operación y mantenimiento de una central eólica con capacidad de 252 MW.

En el Istmo de Tehuantepec hasta el momentos se han instalado 29 parques eólicos. En Juchitán de Zaragoza son 15, todos construidos en tierras comunales.

A LOS COMPAÑEROS SE LES DESPOJARON DE UN RADIO DE COMUNICACIÓN Y SEIS MIL PESOS EN EFECTIVO QUE PERTENECEN A LA JUNTA DE BUEN GOBIERNO.
TERCERO.- EL DELITO DE SECUESTRO ESTÁ PENADO POR LAS LEYES DEL MAL GOBIERNO Y POR LAS LEYES ZAPATISTAS. Communique from the Indigenous Revolutionary Clandestine Committee-General Command of the Zapatista Army for National Liberation

First: On September 11, 2021, in the early morning, while the Zapatista air delegation was in Mexico City, members of ORCAO – a paramilitary organization serving the Chiapas state government – kidnapped the compañeros Sebastián Nuñez Pérez and José Antonio Sánchez Juárez, autonomous authorities from the Good Government Council of Patria Nueva [New Homeland], Chiapas.
The ORCAO is a political-military organization with paramilitary characteristics: they have uniforms, equipment, weapons, and ammunition purchased with money they receive from [government-sponsored] “social programs”. They keep part of the money for themselves and use part of it to pay off government officials for reporting that they [the ORCAO] are complying with the terms of the social programs. They fire on the Zapatista community of Moisés y Gandhi every night with these weapons.
The EZLN has waited patiently as all avenues toward a solution were attempted and exhausted. While the Chiapas state government tried to sabotage and impede freedom for our compañeros, it was human rights organizations and the progressive Catholic church who made an objective assessment of what might happen.
Second: The compañeros were deprived of their liberty for eight days and then freed today, September 19, 2021, thanks to the parish priests of San Cristóbal de las Casas and Oxchuc, of the San Cristóbal diocese. The compañeros were robbed of a walkie-talkie and six thousand pesos in cash belonging to the Good Government Council.
Third: Kidnapping is a crime under both the bad government’s laws and Zapatista law. While the Chiapas state government has supported and covered up these crimes, the Zapatista Army of National Liberation took the necessary steps to free those who were kidnapped and to detain and sanction those who committed the crime.
Fourth: The only reason the conflict did not escalate into a tragedy was due to the intervention of the parishes mentioned above, human rights organizations, and the mobilizations and denunciations carried out in Mexico and, above all, Europe.
Fifth: The misgovernment of Rutilio Escandón is doing everything possible to destabilize the southeastern Mexican state of Chiapas:
It violently represses the normalistas [1].
It sabotages the agreements made between the organized teachers and the federal government, forcing the teachers to take more radical action to demand the agreements be complied with.
Its alliance with narcotraffickers forces indigenous communities to create their own self-defense groups, as the government does nothing to protect the life, liberty, and property of the population. It not only protects the narcotrafficking gangs, but also encourages, promotes, and finances paramilitary groups like those that are constantly attacking communities in Aldama and Santa Martha.
Its vaccination campaign is purposefully slow and disorganized, creating unrest in rural communities that it will no doubt exploit. Meanwhile, the rising covid deaths in these communities are ignored.
Its officials are stealing everything they can from the state treasury, perhaps preparing for a federal government collapse or betting on a new party coming into power.
And now they want to sabotage the departure of the Zapatista delegation participating in the European chapter of the Journey for Life. They ordered their ORCAO paramilitaries to kidnap our compañeros, leaving the crime unpunished, and trying to provoke a reaction from the EZLN, all in a state where governability hangs by a thread.
Sixth: If what the Ecologist Green Party of Mexico (PVEM) wants is to provoke a crisis with international repercussions so that it can destabilize the regime currently in power, they should call a referendum to revoke the presidential mandate.
The PVEM is one of the names used around here by the same old PRI. Sometimes they say it’s the PAN, sometimes the PRD, and now it’s the PVEM badly disguised as the Movement for National Regeneration [MORENA]. But it’s the same criminals as ever, and now they’re part of the misnamed “opposition” movement, a “fifth column” within the 4T [2].
Those responsible are: Rutilio Escandón and Victoria Cecilia Flores Pérez.
If what they want is to topple the federal government, or to cause problems in retaliation for the current federal criminal investigations against them, or to support one of the factions competing for power in 2024, then they should use the available legal channels and stop playing with the life, liberty, and property of the people of Chiapas. They should call for a vote to revoke the presidential mandate and stop playing with fire because they’re going to get burned.
Seventh: We call on Europe below and to the left and on the Sixth in Mexico and abroad to protest in front of Mexican embassies and consulates and at the government offices of the state of Chiapas, demanding an end their provocations and renunciation of their death cult. The date is Friday, September 24, 2021.
Given the actions and omissions of the state and federal governments regarding these crimes and previous ones, we will take the necessary measures to bring justice to the criminals in the ORCAO and the government officials who sponsor them.
