(Español) Victoria para el maíz nativo en México, niegan amparos a gigantes trasnacionales

Por este medio se ha informado sobre la larga y compleja disputa legal protagonizada por la Colectividad Demandante en Defensa del Maíz Nativo (Demanda Colectiva Maíz) y las empresas agroindustriales (Bayer-Monsanto Comercial Semillas y Agroproductos S.A. de C.V., PHI-México, S.A. de C.V., Syngenta y Dow Agrosciencies), suscitada a partir de que los magnates agroindustriales solicitaron amparos respecto a las medidas impulsadas por la Demanda Colectiva Maíz para descontinuar la siembra de maíz transgénico para uso comercial en territorios mexicanos.
Esta situación compleja desembocó una lucha prolongadísima (desde el 2013) que se alimentaba del suspenso. No obstante, no existe plazo que no se cumpla ni lucha que no valga la pena porque, a pesar de que Bayer-Monsanto, PHI, Dow y Syngenta creyeron que era posible esquivar la justicia evadiendo las investigaciones requeridas para demostrar científicamente los riesgos de sus procesos y por ende evitar que se pudiera probar la nocividad de sus productos, el día de ayer (13 de octubre), tras desechar los 130 argumentos (insustentables e insuficientes) con los que las multinacionales intentaban defenderse, la Primera Sala de la Suprema Corte de Justicia de la Nación (SCJN) – ¡por decisión unánime! – ha negado los cuatro amparos de las agroindustriales internacionales (al igual que cualquier impugnación).
Enriqueciendo la victoria, la SCJN determinó que siempre y cuando se cumplan los requisitos de la ley, en los juicios de acción colectiva los jueces tienen la facultad de dictar las medidas pertinentes a favor de la colectividad. La Demanda Colectiva Maíz hereda un precedente para las demandas colectivas contemporáneas y futuras. Se ha empoderado a los campesinos, pueblos indígenas y consumidores de maíz para luchar por sus derechos.
La lucha de la Demanda Colectiva Maíz tiene como principal objetivo el proteger y preservar el maíz nativo que está en el riesgo de desaparecer si continua el uso comercial de transgénicos; además de buscar evitar los efectos negativos sobre la soberanía alimentaria y salvaguardar salud de los consumidores del grano, que se comprometía por la usanza de agrotóxicos.
La realidad es que el efecto del fallo igualmente beneficia a la biodiversidad que ha sido dañada con la introducción de otros transgénicos (como la soya), la apicultura (y las abejas).
Aun así, como la misma Demanda Colectiva Maíz se refiere, “aún nos queda un largo camino por recorrer para lograr la prohibición definitiva de maíces transgénicos en México”.
New aggressions by the paramilitary group ORCAO in Zapatista territory
The Good Government Council of Caracol 10 informed the AJMAQ network that last night, 13 October 2021, a strongly armed group of the paramlitary organization ORCAO (Regional Organization of Coffee Growers from Ocosingo) once again attacked the Zapatista community of Moisés y Gandhi, in an armed aggression that lasted 7 hours and that resulted in the forced displacement of several zapatista families.
This takes place slightly over a month after two Zapatista autonomous authorities were kidnapped by the same group. After that event, and in the context of the lon history of paramilitary violence by ORCAO against Zapatista communities, the Clandestine Revolutionary Indigenous Committee – General Command of the EZLN published a communiqué warning that Chiapas is on the verge of civil war and callingfor national and international solidarity. That call resulted in expressions of solidarity and mobilizations throughout Mexico and the world. AIn spite of all this and the repeated demands to the three levels of the government to stop paramilitary aggressions against the communities that organize peacefully in defense of life, the ORCAO continues to enjoy complete impunity in its criminal actions.

Brothers and sisters, compañeros and compañeras,
The Good Government Council “Nuevo Amanecer en Resistencia y Rebeldía por la Vida y la Humanidad”, Caracol 10 “Floreciendo la Semilla Rebelde,” informed Red de Resistencia y Rebeldía AJMAQ that, slightly over a month after the arbitrary detention of the autonomous authorities José Antonio Sánchez Juárez and Sebastián Núñez Pérez, by the paramilitary group of the Regional Organization of Coffee Growers from Ocosingo (Orcao).
That same group, last night, 13 October 2021, at approximately 20:30, once again attacked the bases of support of the EZLN of the autonomous community of Moisés and Gandhi.
At 1:25 this morning, the gunfire increased, reaching the Autonomous Middle School. At 2:20, the strongly armed group were positioned only 90 feet from the homes of the families bases of support of the EZLN, who were therefore forcefully displaced in search of a safe shelter.
The aggressions of the paramilitary group ended at approximately 3:30, according to information from the Good Government Council.
We demand respect to the land and territory of the Zapatista peoples, their autonomy and free determination.
No more criminal actions by the ORCAO paramilitary group!
No more harassment against the autonomy and life built by the EZLN!
