Mexico: demand grows for release of Chiapas schoolteacher

Groups in Argentina, Brazil, France, England, New Zealand, Scotland, South Africa, Spain, Switzerland and the US are planning events in the May 15-22 “Week of Global Struggle for the Liberation of Alberto Patishtán Gómez and Francisco Sántiz López,” two indigenous prisoners from the southeastern Mexican state of Chiapas. The week of actions was initiated by the New York-based Movement for Justice in El Barrio.

Patishtán Gómez, in prison since 2000, is serving a 60-year sentence for his alleged involvement in the June 2000 killing of seven police agents in El Bosque municipality. Local authorities initially suspected drug traffickers, but prosecutors later shifted their attention to supporters of the rebel Zapatista National Liberation Army (EZLN). Most of El Bosque had been part of a pro-EZLN autonomous municipality, San Juan de la Libertad, from 1995 until 1998, when it was dismantled in a violent military operation. Patishtán Gómez, a local schoolteacher, was the only suspect convicted in the case, and the only witness against him was Rosemberg Gómez, the son of Manuel Gómez Ruiz, then El Bosque’s mayor. Years later Rosemberg Gómez reportedly would tell people when he was drunk that he’d lied on instructions from his father, and that he got a new van as a reward.

Sántiz López, an EZLN supporter, was arrested in December 2011 on charges of leading a confrontation in Tenejapa municipality on Dec. 4 in which one person was killed. La red en lucha

NUEVA YORK, NY.- El Movimiento Sudáfricano de los Habitantes de Casas de Cartón y Movimiento Justicia del Barrio de La Otra Campaña de Nueva York, se solidarizan con la lucha mundial por la liberación de Alberto Patishtán y Francisco Sántiz López, luchadores sociales presos en Chiapas, de manera injusta.

“Sentimos lo mismo, que tu lucha ha sido reprimida, por los opresores de la libertad del mundo”, señala Mzwakhe, ante la comunidad internacional de derechos humanos y movimientos de protesta por la libertad y dignidad. Enfatiza la necesidad de la lucha social como clave para la igualdad y la justicia en el mundo. Su organización es una de las más grandes de Sudáfrica y aboga por la tierra y la vivienda digna.

El activista da un mensaje solidario dirigido a los luchadores sociales chiapanecos  que ahora se encuentran privados de su libertad y les dice que “a toda costa, se tendrá que hacer justicia porque las personas deben de ser iguales y libres en esta tierra”.  La represión por decir la verdad y por luchar contra la pobreza ha sido intensificada, observa el activista internacional, y ofreció a los chiapanecos intensificar también la lucha solidaria para ayudar a liberarlos de la cárcel.

El Movimiento Justicia por el Barrio también manifestó su solidaridad y activó las campañas de difusión internacional para dar a conocer la situación de Alberto Patishtán y Francisco Santís en el mundo. Se reproduce su comunicado público:

Un sol pintado de dolor y esperanza, de dignidad y rabia. No era ni es el sol de ayer, pero será el sol de mañana, el sol de nuestra historia de lucha y resistencia, el sol que calentaba los suelos de nuestros antepasados, que ha vuelto a calentarnos los pasos. Su color no se encuentra ni en el cielo ni en las otras infitas estrellas del Universo, porque este color es compuesto por varios.

Y en la magrugada, su color se llama “rabia.”

Al mediodia, se llama “dignidad.”

En la tarde, le dicen “esperanza.”

Por las noches, “libertad.”

Activist Héctor Manuel Perales Malacara detained in Tlaxcala

El día de hoy alrededor de las 14:30 hrs la PGR ingresó a las oficinas de la Central Nacional Urbana Campesina (CNUC) en la ciudad de Tlaxcala para detener la Héctor Manuel Perales Malacara, quien durante años ha acompañado diversos movimientos en defensa de derechos sociales y económicos de campesinos y comerciantes en la región de Huamantla.

Hechos:

Bajo un fuerte operativo, la PGR ingresó a las oficinas de la organización con la que colabora Héctor Perales Malacara para detenerlo.  Quienes lo acompañaban al momento de la detención dicen que, a decir de los policías que lo detuvieron, su detención responde una orden de aprehensión emitida por el Juez Primero de Distrito en Tlaxcala Ignacio Manuel Cal y Mayor García, con el número de expediente 48/2012, pero los motivos de su aprehensión.  Tras su detención ha sido imposible ubicar su paradero y se teme por su seguridad.

Acción solicitada:

·         Llamar por teléfono a la PGR en Tlaxcala, al Juez Primero de Distrito en Tlaxcala y al Gobierno del Estado de Tlaxcala exigiendo su presentación inmediata, el respeto a sus derechos, al debido proceso y el cese a todo acto represivo en contra de Héctor Perales Malacara.

POR LA LIBERTAD

Hoy 16 de mayo a las 11:40 nos presentamos ante la Dirección General de Reclusorios Federales, ubicada en Londres 102 Col. Juárez, con objeto de exigir un trato digno para nuestro Compañero Alberto Patishtan, dentro del calabozo de Guasave Sinaloa, así como demandar su libertad inmediata, ya que su encierro es totalmente injusto.

Después de instalados, cada uno de los presentes de la Regional Zentro con unas rejas que decían “LIBERTAD PARA ALBERTO PATISTHAN” y otras decías los motivos por los que se encierra a la gente en este país “PORQUE PIENSO” “EN ESTE LUGAR MALDITO DONDE REINA LA TRISTEZA , NO SE CASTIGA EL DELITO, SE CASTIGA LA POBREZA ” entre otras frases, y de estar repartiendo volantes donde se daba a conocer al pueblo en general los porqués nuestros compañeros Alberto y Francisco Sántiez López se encuentran presos, personal de la Dirección de Reclusorios, salieron a “atendernos” en nuestras demandas, fue así que el Lic. Rafael Peña Lozada, Director de Amparos, y el Lic. David Amézquita Pérez, Director de Derechos Humanos, nos manifestaron que se estaba esperando la resolución del amparo que se interpuso para el retorno del Compañero Patisthan al penal del Amate, y que se comprometían a investigar la situación de salud de nuestro compañero así como de cómo esta el trámite para que pueda entrar a verlo su hijo menor, cosas que han estado regateándole al compañero.

Nos proporcionaron sus correos electrónicos y recogieron el nuestro a fin de que nos enviarían en término de dos a tres días, la información que recabaran y que cualquier cosa que deseáramos saber de nuestro compañero, les preguntáramos directamente a estos funcionarios, que se comprometían a llevar un informe al día de la situación. Les manifestamos que aunque no creemos en las autoridades, les concederíamos por esta vez, el beneficio de la duda y que esperaríamos el informe prometido con la agilización de trámites burocráticos.

Después de estar por una hora y fracción, nos retiramos, dada el hostigamiento que la policía federal hace cuando ciudadanos les reclaman en sus instalaciones.

En esta ocasión no tenemos fotos porque el único compañero que pudo tomar alguna, es en cámara no digital y tendremos que esperar a que revele para subirlas.

Por este medio los abajo firmantes exigimos el inmediato traslado en libertad de Alberto Patishtán preso político del estado de Chiapas desde hace 12 años que en octubre del año pasado fue trasladado al CERESO No. 8 de Guasave en Sinaloa, como castigo por haber participado en una huelga de hambre, también exigimos la inmediata liberación del compañero Francisco Santiz López que en Febrero fue detenido injustamente nuestro compañero es base de apoyo zapatista y entendemos que este es el motivo por el cual lo mantienen detenido.

Sabemos que actualmente Felipe Calderón Hinojosa tiene el poder para otorgar el indulto a Alberto Patishtán por eso lo responsabilizamos a él y a los tres niveles de gobierno de mantener secuestrado a nuestro compañero, rompiendo con sus derechos humanos y políticos en varias ocasiones durante estos 12 años, lo cual demuestra que en este sistema la justicia no existe pues solo le sirve a los que despojan, explotan, reprimen y desprecian a los que si trabajamos honradamente, esta en manos del mejor postor y a los que luchamos contra esto se nos castiga.

Exigimos la libertad de los presos políticos de la Otra Campaña y del resto del país, que se restablezcan todos sus derechos y se les haga justicia, castigando también a los responsables de mantener secuestrados a nuestros compañeros.

May 15 to 22 marks “the Week of Global Struggle for the Liberation of Alberto Patishtán Gómez and Francisco Sántiz López: bringing down the prison walls”, which was called by the Movement for Justice in el Barrio from the Other Campaign in New York.

Intense activity is currently taking place on a global scale to demand the release of two indigenous men who have been jailed for their political beliefs and activism, and who have become emblematic figures for the struggle against injustice in prisons and against political repression. Although the prisoners are based in Chiapas, Mexico, activities are taking place in countries including South Africa, Brazil, France, England, Scotland, Spain, the United States, Switzerland, New Zealand and Argentina.

Alberto

Alberto Patishtán Gómez, a Tzotzil from the municipality of El Bosque in the highlands of Chiapas, is often called ‘Professor Patishtán’ because he was an elementary teacher at the local public school.

The municipality of El Bosque is well known in Chiapas, because, in early 1995, supporters of the Zapatista Army of National Liberation (EZLN) declared it an “autonomous” municipality and renamed it San Juan de la Libertad. In the early morning hours of June 10, 1998, more than 1,000 federal troops and state police forces entered San Juan de la Libertad in an operation to dismantle the autonomous municipality. Eight civilians and two police were killed, many injured and dozens arrested.

Alberto Patishtán was arrested on June 19, 2000, along with an EZLN support base, and accused of the ambush and murder of seven police officers which had taken place earlier that month. The people who carried out the ambush were well-trained, highly organised and heavily armed, and must have had inside information, but the elections were due on July 1, and there was heavy pressure for a quick arrest.

Patishtán’s co-accused was acquitted at the trial because the only witness, the son of the mayor, was “openly lying”. This witness provided the only evidence against the Professor, who was nevertheless sentenced to sixty years in prison. Patishtán’s conviction is thought to be related to his active participation in the political life of his community at the time of his arrest. He had recently signed a letter written to the governor denouncing the then municipal government for arbitrary actions, corruption, and abuses, and requesting the dismissal of the mayor and the election of a new municipal council.

In jail, Patishtán continued his activism, working for the freedom of political prisoners and denouncing human rights violations. The Fray Bartolome de las Casas Human Rights Centre (Frayba) has emphasized that “for more than 11 years of his undeserved sentence,” the professor “has been a model of social struggle in support of the most forgotten, the poor and the indigenous”. In 2005, he founded the prisoners’ organization, ‘the Voice of El Amate’, and in 2010 he received the “jTatic Samuel jCanan Lum” award in recognition of his work. Two years ago, Juan Sabines Guerrero, governor of Chiapas, publicly declared Patishtán’s innocence and committed to releasing him, after visiting him in a prison hospital, but neglected to do so.

In October 2011, while participating in a hunger strike for the freedom of prisoners and acting as their spokesperson, Patishtán was transferred to a state prison in Guasave, Sinaloa, more than 2000 km from his family. The move was clearly designed as a punishment for his human rights work and to separate him from the other hunger strikers. Although the Chiapas government has denied requesting this transfer, it says in the injunction file that the General Secretary of Government for the State of Chiapas, Noé Castañón León, requested a transfer “to another penitentiary outside the state of Chiapas”.

At the end of February, the district judge in Tuxtla Gutiérrez decided to order Patishtán’s return to Chiapas. However, the Mexican president intervened: “Nevertheless, Felipe Calderón, through the federal Secretary of Public Security, filed an appeal on April 3 to delay or annul his return,” denounced Frayba, who have been instrumental in the movement for his liberation.

Alberto Patishtán has suffered from glaucoma for two years. His eyesight is deteriorating because he is not receiving the appropriate medical treatment. He is only allowed out of his cell for an hour each week, and can only receive one phone call every fifteen days. Members of Colectivo Ik’, who have visited him, report: “the federal centres are prisons where the most perverse methods of torture are implemented….under the custody of public officials, the guards and the technical team systematically carry out methods directed at humiliating, punishing and obliterating the personality of the prisoners”.

Because of his political activity before his arrest and his work in defence of human rights within prison, Professor Alberto Patishtán Gómez is regarded as a political prisoner.

On 17 March 2012, more than a thousand people came together in El Bosque to demand Patishtán’s return to Chiapas and his unconditional release. They remembered the acts that occurred 12 years ago on the day of the alleged ambush and stressed that Alberto was not at the scene of the incident. “I spoke with him that day, at the very hour; he could not have been where the violence occurred.” But their testimony was never taken into account: “We went to San Cristóbal and Tuxtla to declare the same thing we say now, but no one listened”.

Francisco

On December 4, 2011, a group of fifty armed members of the PRI made a fierce and prolonged attack on four families in the Banavil ejido, municipality of Tenejapa, and threw them out of their homes and community. Such attacks with firearms by members of political parties and/or paramilitary groups have become commonplace in communities of Zapatista supporters or Other Campaign adherents. The aims are twofold: to seize the reclaimed land and to weaken and destroy the autonomous communities and the dream they represent. In this case the families concerned had no political affiliation, but were said to be ‘sympathetic to the Zapatistas’.

The aggressions that occurred on December 4 resulted in the death of Pedro Méndez López (PRI member); the displacement of four families ‘accused’ of being Zapatista sympathizers; the disappearance of Alonso López Luna (presumed dead); the detention of Alonso’s son Lorenzo López Girón, shot twice and seriously injured while trying to defend his father, and detained, accused of causing bodily injury; injuries to six more people; and the arbitrary detention of Francisco Santiz Lopez, civilian Zapatista support base, who was not even at the scene of the crime when it occurred.

Francisco Sántiz López is a Tzeltal trader from Banavil, who operates a fruit and vegetable stall in the market in the municipal headquarters of Tenejapa, and has been a support base of the EZLN for over 20 years. He was arrested in December 2011, and initially accused of “leading a confrontation”, a charge relating to the events described above. He was charged with murder, and imprisoned, even though twelve witnesses confirmed that he was not present at the time of the attack. According to the Good Government Junta in the Caracol of Oventic, he was later offered the opportunity to “buy” his freedom.

On March 22, 2012, Santiz was told he had been cleared of murder charges and would be released. However, as he was leaving the prison he was informed of a new charge, “carrying firearms for the exclusive use of the army”, and was re-arrested and again imprisoned. He was unarmed when first arrested and has never been found in the possession of firearms. Lorenzo López Girón was released at this time, still carrying two bullets in his body.

The displaced family of Alonso López Luna, of whom only an arm has been found, have stated, “we demand the freedom of Francisco Sántiz López, since he was not at the scene of the attacks; it was not us who attacked the party members, it was they who came to our homes to attack us. At the time of the attack compañero Francisco was at his fruit stall in the county headquarters, some of us went there to ask for his help”.

The harassment of EZLN sympathizers in Banavil dates from 2009, and results from their opposition to arbitrary acts by the PRI caciques (political bosses): land grabs, illegal cutting of trees, collecting unfounded taxes and contributions, break-ins, physical attacks and denial of the right to education, among others. The victims have denounced these acts before government agencies, who, they say, “ignore them”. Meanwhile, as Frayba points out, “there exists no effective investigation or punishment of those responsible, and the authorities don’t intervene to resolve the situation or to guarantee legal and social security in Banavil.”

The unjust imprisonment of Francisco Sántiz López and the fabrication of crimes against him can be seen as part of the government’s strategy of low-intensity warfare designed to destroy the resistance of the Zapatista communities. “His only crime” says the Junta, “is struggling for his pueblo, telling the truth, struggling for true democracy, liberty and justice”. For this reason he is also regarded as a political prisoner.

In the words of the campaign, “the unjust incarceration of Francisco is not an isolated case, but one that forms part of the continuous war by the Mexican State against the Zapatista communities, a war that through harassment, attacks and arbitrary detentions seeks to undermine and annihilate the resistance and process of autonomy that the Zapatista support bases are bringing to a head in Chiapas”.

The campaign

The campaign to free the political prisoners in Chiapas is thus set in a context of the criminalisation of social protest, where Zapatista supporters and Human Rights defenders endure continuous harassment and threats.

In both cases, independent lawyers, human rights organisations and autonomous Zapatista authorities have affirmed the men’s innocence. They place responsibility on the President of Mexico, Felipe Calderón Hinojosa, and the governor of Chiapas, Juan Sabines Guerrero, for keeping the prisoners detained for political reasons and in order to cover up the presence of paramilitary groups in the communities of the two men.

The growing international campaign on behalf of these political prisoners has involved a very diverse range of activities. Audios, videos and films have been produced, and messages on Twitter and Facebook directed at the president have been generated and multiplied. A forum has been held in San Cristobal, and Patishtán’s community are to host a march and rally. Letter-writing and petitions have been organised, and letters written to Alberto in prison on his birthday. The cases were highlighted during the gathering for International Political Prisoners’ Day in Paris.

The Week of Global Action convoked by the Movement for Justice in el Barrio from the Other Campaign in New York is the next stage in the campaign. Groups expressing solidarity include the Shack Dwellers’ Movement from South Africa, and the Brazilian Landless Peoples’ Movement (MST).

The campaign emphasizes that the federal and state governments “have made public opinion believe that they respect the right of indigenous peoples, and in particular their self- determination and autonomy, but in reality they maintain a violent assault against the Zapatista communities, utilizing groups of a paramilitary appearance or organizations affiliated with the political parties.”

The federal government, it adds, “has wanted to deny the existence of the political prisoners in the country and is quiet about their presence in Chiapas.” Government publicity campaigns present the state “as a paradise of peace, tranquillity and order, respectful of human rights and diversity,” in reality this hides “the sale of the natural wealth of Chiapas to mining companies, lumber companies, pharmaceutical companies, bio-diesel exploiters, tourism companies, hotel chains, energy companies and other industries.”

Pronunciamiento del Foro contra la prisión política y por la libertad de Alberto Patishtán
El pasado 12 y 13 de mayo se realizó en las instalaciones de CIDECI-Unitierra situado en la ciudad de San Cristóbal de Las Casas, un Foro contra la prisión política y por la libertad de Alberto Patishtán Gómez convocado por la Red contra la Represión y por la Solidaridad.
Acudieron al Foro más de doscientas personas de diferentes nacionalidades y pertenecientes a más de 50 organizaciones, comunidades y colectivos de Mexico y de otros paises.
A través de familiares de presos y presas, y varias organizaciones, un total de 21 pres@s y expres@s fueron representados en el Foro Contra la Prision Politica y por la Libertad de Alberto Patishtán.
La palabra de nuestros presos y presas llegó a traves de ponencias realizadas por compañer@s y familiares. También las voces de algunos de ellos estuvieron presentes mediante grabaciones de audio, así desde el Ceferezo, penal de máxima seguridad Guasave Sinaloa llegó la palabra de Alberto Patishtán Gómez, la de l@s Solidari@s de la Voz del Amate desde el CERSS Nº 5 de San Cristóbal de Las Casas y la de Máximo Mojica desde Guerrero. También se mostraron video grabaciones, como el video que realizaron los compañeros y compañeras del Movimiento por Justicia en el Barrio de Nueva York, y se leyeron cartas de organizaciones internacionales solidarias, que aunque por distancia geografica no pudieron estar presentes, los sentimos cerca durante todo el evento. Para estas organizaciones que nos demuestran que la solidaridad no entiende de fronteras, sino que en la distancia los lazos de solidaridad se siguen tejiendo conjuntamente, les enviamos un fuerte abrazo. A Les Trois Passants de Francia, a la Plataforma Vasca de Solidaridad con Chiapas de Euskal Herria, a la Plataforma Pirata de Italia, Suiza y México y a la CGT del Estado Español.
En este mismo sentido queremos mostrar nuestra solidaridad hacia la compañera del Estado Español Laura Gómez de la CGT-Barcelona que desde el pasado 25 de abril se encuentra privada de libertad.
Así como también l@s tres compañer@s que se encuntran privad@s de libertad en Suiza y que responden a los nombres de Costa, Silvia y Billi.
De esta manera pudimos conocer sus historias y constatar que nuestro dolor es un trazo más dentro del mapa represivo que dibuja el mal gobierno y las instituciones encargadas de impartir justicia. También vimos que muchas son nuestras luchas y much@s l@s compañer@s que estan privados de libertad por el hecho de que estas luchas son parte vital en su caminar.
Vemos que la represión es una constante, es un camino que los de arriba van dibujando transfiriendole mayor o menor intensidad, pero que no cesa y es parte intrínseca de este sistema en el cual se polariza de forma extrema la violencia, siendo esta monopolio exclusivo del Estado. Vemos también que la prisión es un medio disuasorio que a traves del miedo ejerce un control social y político. Pero que a traves del trabajo colectivo, del apoyo mutuo, del constituirnos como parte de un todo que conserva las particularidades de cada quien, hemos de superar esos miedos, hemos de vencerlos.
Así pues en el transcurso del dia 12 de mayo se dieron a conocer los siguientes casos de compañeros y compañeras que en su mayoría se encuentran privad@s de libertad en un contexto de prisión política:

El dia 13 de mayo se realizaron diferentes mesas de trabajo con el fin de extructurar un calendario de lucha en torno a los ejes de prisión política y la liberación de Alberto Patishtán, poniendo también especial atención en l@ compañer@s pres@s que fueron representad@s durante el foro.
Estas son algunas de las acciones que se llevaran a cabo proximamente y las cuales enmarcamos dentro de la Semana Mundial por la libertad de Alberto Patishtán y Francisco Sántiz “A tumbar las paredes del calabozo”:
  • Marcha-mitin en la cabecera municipal del Bosque el día 18 de mayo a las 12h del día. Mitin simultaneo por el Movimiento por la Paz con Justicia fuera la reprepresentación de la casa del gobierno de Chiapas en el DF.
  • 19 de mayo: Evento político-cultural en los distintos estados, en solidaridad con las comunidades zapatistas. También se abordará la prisión política.
  • Pase de video del colectivo Koman Ilel sobre Alberto Patishtán.
  • Acto de solidaridad en la comunidad de Cruztón.
  • Acto de Solidaridad en el Pueblo organizado San Francisco.
  • Acto de Solidaridad en Candelaria el Alto.
  • Mitin informativo sobre comunidades zapatistas y pres@s polític@s en Bellas Artes ciudad de México, el mismo 19 de junio como parte de esta acción. En San Cristóbal de las Casas a las 18 horas en el Paliacate.
  • 19 de mayo: Evento en solidaridad con las comunidades zapatistas y por la libertad de Patishtán en Oaxaca.
  • Dislocada nacional e internacional el 19 de junio para exigir la libertad de Alberto Patishtán.
  • Dislocada nacional e internacional en septiembre- octubre.
  • Campaña nacional e internacional de pronunciamientos para exigir la libertad de l@s pres@s políticos y denunciar violaciones de derechos humanos.
  • Caravana de visitas y denuncia en los penales donde están nuestr@s pres@s.
  • También se ha creado un blog donde se podrá dar continuidad a nuestr@s pres@s polític@s.

Por otra parte queremos remarcar la importancia de no dejar en el olvido a l@s compañer@s que están en prisión, ell@s constituyen una parte importantísima de nuestra lucha y nuestro caminar.
Nuestro compromiso es con los de abajo, con los desposeidos, y la prisión es una maquila que trabaja incesantemente para tratar de despojarnos de nosotros mismos, de nuestra identidad, de nuestra historia. Esa es la lucha diaria de nuestr@s pres@s, y también de la nuestra ya que ell@s son la representación de un compromiso inalterable.

Zapatistas apoyan la “Semana de Lucha Mundial por Patishtán y Sántiz López: A Tumbar las Paredes del Calabozo”

The Good Government Council of Oventic and relatives of the Zapatista Base of Support Francisco Sántiz López sent two special messages on the actions for the “Week of Worldwide Struggle for the Freedom of Patishtán and Sántiz López.” The original audios of these texts, read by a representative of the Good Government Council and two relatives of Francisco, appear in full in the new documentary produced by the Movement for Justice of El Barrio, The Other Campaign New York.
