{"id":53142,"date":"2025-12-12T15:29:50","date_gmt":"2025-12-12T21:29:50","guid":{"rendered":"https:\/\/radiozapatista.org\/?p=53142"},"modified":"2025-12-12T15:33:41","modified_gmt":"2025-12-12T21:33:41","slug":"caso-antonio-gonzalez-mendez-ante-la-corte-idh-a-un-ano-de-la-sentencia-acciones-del-estado-sin-diligencia-ni-eficacia","status":"publish","type":"post","link":"https:\/\/radiozapatista.org\/?p=53142","title":{"rendered":"[:es]Caso Antonio Gonz\u00e1lez M\u00e9ndez ante la Corte IDH: a un a\u00f1o de la Sentencia acciones del Estado sin diligencia ni eficacia[:en]Antonio Gonz\u00e1lez M\u00e9ndez Case before the IACHR: One Year After the Ruling, State Actions Lack Diligence and Effectiveness[:]"},"content":{"rendered":"[:es]\n\n<p class=\"has-text-align-right wp-block-paragraph\">San Crist\u00f3bal de Las Casas, Chiapas, M\u00e9xico<br>12 de diciembre de 2025<\/p>\n\n\n\n<p class=\"has-text-align-right wp-block-paragraph\"><strong>Bolet\u00edn de prensa No. 11<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>&nbsp;<br>Caso Antonio Gonz\u00e1lez M\u00e9ndez ante la Corte IDH: a un a\u00f1o de la Sentencia hist\u00f3rica<br>ni las investigaciones ni las acciones de b\u00fasqueda han sido diligentes y eficaces<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>El cumplimiento de la sentencia no ha sido debidamente priorizado por el Estado mexicano.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">El 12 de diciembre de 2024, la Corte Interamericana de Derechos Humanos (Corte IDH) notific\u00f3 su sentencia de condena al Estado mexicano por la desaparici\u00f3n forzada de Antonio Gonz\u00e1lez M\u00e9ndez Base de Apoyo del EZLN, desaparecido el 18 de enero de 1999, en el municipio de Sabanilla, Chiapas, por integrantes del grupo paramilitar \u201cOrganizaci\u00f3n Desarrollo Paz y Justicia\u201d en el marco de la puesta en marcha del contexto de violencia contrainsurgente a trav\u00e9s de la implementaci\u00f3n del Plan de Campa\u00f1a Chiapas 94.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Sentencia reafirm\u00f3 que las desapariciones forzadas cometidas en el contexto del Conflicto Armado Interno, iniciado el 1 de enero de 1994, no prescriben y obliga al Estado mexicano a dar cuentas y lo que representa un precedente hist\u00f3rico para otras v\u00edctimas de graves violaciones de derechos humanos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pr\u00f3ximos a cumplirse 27 a\u00f1os de su desaparici\u00f3n, el Estado mexicano contin\u00faa con simples tr\u00e1mites administrativos, superficiales, encaminadas a ser una investigaci\u00f3n infructuosa; tanto la b\u00fasqueda como las investigaciones no han sido diligentes y eficaces para dar con el paradero de Antonio Gonz\u00e1lez M\u00e9ndez. Lo que para la Fiscal\u00eda Estatal es la hip\u00f3tesis de la desaparici\u00f3n a manos de grupo paramilitar devela un caso que sigue sin ser clarificado, se sigue sin tomar en cuenta la sentencia de la Corte IDH que ya da por hecho esta hip\u00f3tesis y adem\u00e1s responsabiliza al Estado mexicano por impulsar a los grupos paramilitares en la zona; todo esto genera dudas sobre la seriedad del compromiso Estatal. Es fundamental esclarecer plenamente lo ocurrido e individualizar, juzgar y, en su caso, sancionar a todos los autores intelectuales y materiales de este crimen de lesa humanidad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La obligaci\u00f3n del gobierno de M\u00e9xico no debe quedar en actos simb\u00f3licos o en simple papel; la investigaci\u00f3n debe contener l\u00edneas claras que identifique a los responsables, tanto materiales como intelectuales, y los procese conforme a los est\u00e1ndares de derechos humanos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La persistente impunidad y el incumplimiento parcial de la Sentencia de la Corte IDH evidencian las enormes dificultades para traducir un fallo internacional en transformaciones reales y palpables. El eje central sigue siendo la localizaci\u00f3n de Antonio Gonz\u00e1lez M\u00e9ndez y la realizaci\u00f3n de una investigaci\u00f3n profesional, cient\u00edfica y aut\u00f3noma que garantice justicia y verdad. Este caso no solo refleja la deuda pendiente con su familia, sino que expone de manera cruda la crisis estructural de derechos humanos, justicia e impunidad que atraviesa M\u00e9xico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Estado mexicano tiene la obligaci\u00f3n de materializar las reformas estructurales ordenadas por la Corte IDH: un registro nacional y actualizado de personas desaparecidas, programas eficaces de prevenci\u00f3n, formaci\u00f3n especializada para investigar cr\u00edmenes de Estado, y pol\u00edticas p\u00fablicas que reconozcan los derechos colectivos de los pueblos originarios bajo un enfoque integral de derechos humanos. No se trata \u00fanicamente de cumplir con una sentencia, sino de transformar las instituciones para que nunca m\u00e1s se repitan estas violaciones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Desde el Frayba, junto con la familia de Antonio Gonz\u00e1lez M\u00e9ndez, seguiremos insistiendo en que la justicia se cumpla en su totalidad. Persistiremos en la b\u00fasqueda de la verdad y en la exigencia de justicia, porque solo as\u00ed se podr\u00e1 honrar la memoria de Antonio y abrir camino hacia un M\u00e9xico donde la impunidad no sea la regla, sino la excepci\u00f3n. Esta lucha, es tambi\u00e9n la lucha por todas las personas desaparecidas y por la dignidad de los pueblos que reclaman verdad, justicia y no repetici\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/frayba.org.mx\/sites\/default\/files\/2025-12\/251205_boletin_11_agm_final.pdf\">Descarga el Bolet\u00edn No. 11 en PDF<\/a> (188.59 KB)<\/p>\n\n\n[:en]\n\n<p class=\"has-text-align-right wp-block-paragraph\"><strong>San Crist\u00f3bal de Las Casas, Chiapas, Mexico<br>December 12, 2025<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-right wp-block-paragraph\"><strong>Press Release No. 11<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>Antonio Gonz\u00e1lez M\u00e9ndez Case before the IACHR: One Year After the Historic Ruling<br>Neither the investigations nor the search efforts have been diligent or effective<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The enforcement of the ruling has not been properly prioritized by the Mexican State.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On December 12, 2024, the Inter-American Court of Human Rights (IACHR) notified its ruling condemning the Mexican State for the forced disappearance of Antonio Gonz\u00e1lez M\u00e9ndez, an EZLN Support Base, who was disappeared on January 18, 1999, in the municipality of Sabanilla, Chiapas, by members of the paramilitary group &#8220;Organization for Development, Peace, and Justice&#8221; in the context of the counterinsurgency violence triggered by the implementation of the Chiapas Campaign Plan 94.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling reaffirmed that forced disappearances committed within the context of the Internal Armed Conflict, which began on January 1, 1994, are not subject to statute of limitations and obliges the Mexican State to be held accountable. This represents a historic precedent for other victims of severe human rights violations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the 27th anniversary of his disappearance approaches, the Mexican State continues with mere administrative procedures, superficial efforts aimed at conducting an unfruitful investigation. Both the search and the investigations have not been diligent or effective in locating Antonio Gonz\u00e1lez M\u00e9ndez. What the State Prosecutor&#8217;s Office considers the hypothesis of his disappearance at the hands of a paramilitary group reveals a case that remains unresolved. The IACHR ruling, which takes this hypothesis as a fact and holds the Mexican State responsible for supporting paramilitary groups in the region, continues to be disregarded, raising doubts about the seriousness of the State\u2019s commitment. It is essential to fully clarify what happened and to identify, prosecute, and, if applicable, sanction all intellectual and material authors of this crime against humanity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The obligation of the Mexican government must not be reduced to symbolic actions or mere paperwork; the investigation should include clear lines of action to identify those responsible, both material and intellectual, and prosecute them in accordance with human rights standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The persistent impunity and partial non-compliance with the IACHR ruling highlight the enormous challenges in translating an international ruling into real and tangible changes. The central issue remains the location of Antonio Gonz\u00e1lez M\u00e9ndez and the carrying out of a professional, scientific, and independent investigation that guarantees justice and truth. This case not only reflects the pending debt to his family but also starkly exposes the structural crisis of human rights, justice, and impunity that Mexico is facing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Mexican State is obligated to implement the structural reforms ordered by the IACHR: a national and up-to-date registry of missing persons, effective prevention programs, specialized training to investigate state crimes, and public policies that recognize the collective rights of indigenous peoples through a comprehensive human rights approach. It is not just about complying with a ruling, but about transforming institutions so that these violations are never repeated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At Frayba, alongside the family of Antonio Gonz\u00e1lez M\u00e9ndez, we will continue to insist that justice be fully served. We will persist in the search for the truth and the demand for justice, because only in this way can we honor Antonio&#8217;s memory and pave the way for a Mexico where impunity is the exception, not the rule.
