Sin embargo, contin\u00faa privado de su libertad en el Centro Estatal de Reinserci\u00f3n Social No. 7 (CERSS) de Tapachula. El Centro de Derechos Humanos Fray Bartolom\u00e9 de Las Casas (Frayba) y la Organizaci\u00f3n Mundial Contra la Tortura (OMCT) exigimos al Poder Judicial de Chiapas revertir las violaciones sistem\u00e1ticas a sus derechos humanos y ordenar su liberaci\u00f3n inmediata.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Osm\u00e1n Iv\u00e1n fue detenido el 2 de mayo de 2011 en Huixtla, Chiapas, en un operativo realizado por la Polic\u00eda Municipal, la Polic\u00eda Estatal Preventiva (PEP) y la Polic\u00eda Estatal Fronteriza (PEF), sin orden de aprehensi\u00f3n y bajo circunstancias que constituyen detenci\u00f3n arbitraria y tortura.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acuerdo con su testimonio, durante la detenci\u00f3n fue vendado, amarrado, golpeado, asfixiado con agua, sometido a descargas el\u00e9ctricas, privaci\u00f3n sensorial y agresiones f\u00edsicas y psicol\u00f3gicas, hasta ser obligado a autoinculparse en diversos delitos. Estas agresiones fueron documentadas por la Comisi\u00f3n Estatal de Derechos Humanos (CEDH), que registr\u00f3 lesiones compatibles con tortura y emiti\u00f3 en 2020 la Recomendaci\u00f3n 013\/2020-R, rechazada por la FGE y la Secretar\u00eda de Seguridad y Protecci\u00f3n Ciudadana (SSyPC).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Los tres procesos penales en su contra derivan de declaraciones obtenidas bajo coacci\u00f3n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Privaci\u00f3n Ilegal de la Libertad en grado de tentativa y Delincuencia Organizada (causa penal 177\/2023): permanece en etapa de instrucci\u00f3n desde hace m\u00e1s de 13 a\u00f1os, sin que el Juzgado del Ramo Penal del Distrito Judicial de Tapachula le dicte sentencia.<\/li>\n\n\n\n<li>Homicidio Calificado (causa penal 423\/2023): sentencia dictada en 2023 con base en confesiones ministeriales y testimonios que no lo identifican; revocada en 2024 para investigar la tortura denunciada. El 4 de noviembre de 2025 fue finalmente absuelto.<\/li>\n\n\n\n<li>Portaci\u00f3n de arma de fuego sin licencia: causa federal en la que fue absuelto en 2014.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La documentaci\u00f3n del Frayba revela irregularidades sistem\u00e1ticas: fabricaci\u00f3n de pruebas, contradicciones en partes policiales, peritajes manipulados y actuaciones ministeriales que ignoraron denuncias tempranas de tortura. La CEDH constat\u00f3 que la detenci\u00f3n no ocurri\u00f3 en el lugar de los hechos del supuesto secuestro y que no existi\u00f3 identificaci\u00f3n directa por parte del denunciante, descartando la flagrancia invocada por las autoridades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tras casi 15 a\u00f1os de prisi\u00f3n, Osm\u00e1n Iv\u00e1n enfrenta un proceso marcado por violaciones al debido proceso, racismo, ausencia de asistencia consular, falta de investigaci\u00f3n efectiva y dilaciones injustificadas, que lo mantienen en una prisi\u00f3n preventiva prolongada contraria a los est\u00e1ndares internacionales. Ante esta impunidad sostenida por el Estado mexicano, el Frayba y la OMCT presentaron en agosto de 2024 una denuncia ante el Comit\u00e9 de Derechos Humanos de la ONU, registrada en abril de 2025 bajo el n\u00famero 4740\/2025, a\u00fan pendiente de resoluci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>El Frayba y la OMCT <\/strong>hacen un llamado urgente a las autoridades de los gobiernos estatal y federal para que garanticen una investigaci\u00f3n exhaustiva e imparcial sobre la tortura denunciada, Adem\u00e1s, exigimos garantizar el acceso a la justicia y reparar las violaciones cometidas en agravio de Osman Iv\u00e1n Rubio Bonilla, empezando con su liberaci\u00f3n incondicional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>El caso de Osm\u00e1n<\/strong> Iv\u00e1n Rubio Bonilla <strong>es un s\u00edmbolo de la violencia institucional y del racismo<\/strong> que atraviesa el sistema de justicia en M\u00e9xico. <strong>Su libertad no es una concesi\u00f3n: es un derecho arrebatado por la tortura y la arbitrariedad<\/strong>. Cada d\u00eda que permanece encarcelado prolonga la injusticia y la impunidad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Exigimos su liberaci\u00f3n inmediata e incondicional<\/strong>. La dignidad de Osm\u00e1n Iv\u00e1n, y la de todas las personas sobrevivientes de tortura y detenci\u00f3n arbitraria, no puede seguir esperando.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/frayba.org.mx\/sites\/default\/files\/2025-12\/251204_boletin_10_libertad_osman_0.pdf\">Descarga el Bolet\u00edn No. 10 en PDF<\/a>(180.55 KB)<\/p>\n\n[:en]\n\n<p class=\"has-text-align-right wp-block-paragraph\"><strong>San Crist\u00f3bal de Las Casas, Chiapas, Mexico<br>December 3, 2025<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-right wp-block-paragraph\"><strong>Bulletin No. 10<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>Osm\u00e1n Iv\u00e1n: victim of torture, arbitrary detention, and institutional racism<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>15 years of injustice\u2014freedom cannot wait.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Osm\u00e1n Iv\u00e1n Rubio Bonilla, a Honduran citizen unjustly accused in three case files by the Chiapas State Attorney General\u2019s Office (FGE) and a survivor of torture, was acquitted of homicide on November 4, 2025, after 14 years and 6 months of tireless resistance. However, he remains deprived of his liberty at the State Center for Social Reintegration No. 7 (CERSS) in Tapachula. The Fray Bartolom\u00e9 de Las Casas Human Rights Center (Frayba) and the World Organisation Against Torture (OMCT) call on the Judicial Branch of Chiapas to reverse the systematic violations of his human rights and order his immediate release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Osm\u00e1n Iv\u00e1n was detained on May 2, 2011, in Huixtla, Chiapas, during an operation carried out by the Municipal Police, the State Preventive Police (PEP), and the State Border Police (PEF), without an arrest warrant and under circumstances that constitute arbitrary detention and torture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to his testimony, during the arrest he was blindfolded, bound, beaten, asphyxiated with water, subjected to electric shocks, sensory deprivation, and physical and psychological abuse, until he was forced to incriminate himself in various crimes. These assaults were documented by the State Human Rights Commission (CEDH), which recorded injuries consistent with torture and issued Recommendation 013\/2020-R in 2020, rejected by the FGE and the Secretariat of Security and Citizen Protection (SSyPC).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The three criminal proceedings against him stem from statements obtained under coercion:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Attempted Illegal Deprivation of Liberty and Organized Crime (criminal case 177\/2023):<\/strong> has remained in the evidentiary stage for over 13 years, without the Criminal Court of the Tapachula Judicial District issuing a ruling.<\/li>\n\n\n\n<li><strong>Aggravated Homicide (criminal case 423\/2023):<\/strong> a sentence was issued in 2023 based on ministerial confessions and testimonies that did not identify him; overturned in 2024 to investigate the reported torture. On November 4, 2025, he was finally acquitted.<\/li>\n\n\n\n<li><strong>Carrying a firearm without a license:<\/strong> a federal case in which he was acquitted in 2014.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Frayba\u2019s documentation reveals systematic irregularities: fabrication of evidence, contradictions in police reports, manipulated expert examinations, and prosecutorial actions that ignored early reports of torture. The CEDH confirmed that the arrest did not occur at the location of the alleged kidnapping and that there was no direct identification by the complainant, ruling out the flagrancy invoked by authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After nearly 15 years in prison, Osm\u00e1n Iv\u00e1n faces a process marked by violations of due process, racism, lack of consular assistance, absence of effective investigation, and unjustified delays that keep him in prolonged pretrial detention, contrary to international standards. In the face of impunity sustained by the Mexican State, Frayba and OMCT filed a complaint in August 2024 before the UN Human Rights Committee, registered in April 2025 under number 4740\/2025, still pending resolution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Frayba and OMCT urgently call on state and federal authorities to ensure a thorough and impartial investigation into the reported torture. In addition, we demand guarantees for access to justice and reparation for the violations committed against Osm\u00e1n Iv\u00e1n Rubio Bonilla, beginning with his unconditional release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case of Osm\u00e1n Iv\u00e1n Rubio Bonilla is a symbol of institutional violence and racism that permeates the justice system in Mexico. His freedom is not a concession\u2014it is a right taken from him through torture and arbitrariness. Every day he remains imprisoned prolongs injustice and impunity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>We demand his immediate and unconditional release.
