La comunidad maya de Ixil, en el estado de Yucatán, obtuvo en la justicia la suspensión provisional, dictada por el Juzgado Primero de Distrito de Yucatán, que deja sin efecto una orden de la Fiscalía General del Estado, implementada el 17 de agosto mediante un violento operativo de la Secretaría de Seguridad Pública, que resultó en el cierre de cientos de hectáreas de tierras comunitarias que cultivan familias indígenas y campesinas.

De acuerdo a un comunicado de prensa de la comunidad, miembros de las familias Abimerhi y Millet, con vínculos políticos y personales con el gobernador Mauricio Vila Dosal y con el titular de la Secretaría de Seguridad Pública, Luis Felipe Saidén Ojeda, han intentado apropiarse de estas tierras comunitarias desde agosto de 2022.

La orden de la Fiscalía, emitida en el marco de una “supuesta investigación de la cual la comunidad no tiene conocimiento, está siendo utilizada para despojar a la comunidad”, sostienen. Las familias “están marcando lotes en las tierras comunitarias para avanzar en la planeación de un megaproyecto inmobiliario”.

La orden emitida por la Fiscalía impidió la ampliación de un sistema colectivo de riego fotovoltaico planeado en el marco de un proyecto de investigación financiado por el Consejo Nacional de Humanidades, Ciencias y Tecnologías (CONAHCYT), dado que su implementación estaba planeada para los meses de septiembre y octubre, informan.

En el ámbito del proyecto ya existen tres sistemas de riego colectivo fotovoltaico instalados, además de otras acciones implementadas con grupos de productores de hortalizas y de mujeres y jóvenes que comparten el uso de un vivero tecnificado. “Todas estas instalaciones se encuentran en las tierras aseguradas por la Fiscalía, de las que pretenden apropiarse las familias Abimerhi y Millet”, señalan.

Sin presencia de principales responsables del caso, padres y madres de Ayotzinapa denuncian ante la CIDH obstaculización de la justicia
Washington DC, 9 de noviembre de 2023.- Frente a la ausencia de autoridades de alto nivel responsables en el esclarecimiento de los hechos del caso de desaparición de estudiantes normalistas de Ayotzinapa, padres y madres de las y los estudiantes presentaron ante la Comisión Interamericana de Derechos Humanos (CIDH) la actualización de los últimos eventos del caso y presentaron solicitudes puntuales, esto durante la audiencia convocada por la CIDH como parte del seguimiento de la medida cautelar 409-14.

Cristina Bautista, madre de Benjamín Ascensio Bautista, y Mario González padre de César Manuel González Hernández, acompañados por representantes de Fundar, Centro de Análisis e Investigación A.C., el Centro de Derechos Humanos de la Montaña “Tlachinollan” y el Centro de Derechos Humanos Miguel Agustín Pro Juárez (Centro Prodh), enfatizaron que a más de 9 años de los hechos aún no han alcanzado verdad ni justicia, ni se conoce el paradero de los estudiantes; por el contrario, se mantiene la obstaculización por parte del Ejército para entregar información relevante para el esclarecimiento de lo ocurrido, no hay claridad en las líneas de investigación y han recibido evasivas de las autoridades. Lo anterior se vio reflejado en la falta de comparecencia en la audiencia de autoridades relevantes en el asunto, como el actual Subsecretario de Derechos Humanos y Presidente de la COVAJ y el actual titular de la Fiscalía Especial para el caso.

“Veo que el Estado no toma en serio el caso Ayotzinapa. El nuevo Fiscal, el nuevo Subsecretario no están presentes. Como padres y madres no nos rendiremos, por el amor de nuestros hijos nos mantenemos de pie”, expresó Cristina Bautista.

Mario González añadió: “Ahora vemos toda la descalificación hacia nosotros, la falta de respeto de no venir los principales [autoridades] para poder hablar con ellos. Un ejemplo de ello es la salida del GIEI, que buscaron tener acceso a una serie de documentos de los Centros Regionales de Fusión de Inteligencia, que podrían contribuir a saber qué pasó con nuestros hijos. Esos documentos tienen muchísima información, son reportes militares, son transcripciones de llamadas entre perpetradores, son pistas. Y no entendemos por qué el Ejército no quiere entregar esa información”.

Junto con sus representantes, los padres presentaron cuatro peticiones puntuales ante las y los comisionados de la CIDH:

1. Dado que se ha informado que el Presidente de la República supervisará directamente las investigaciones, se solicitó que continúe haciendo uso de todos los mecanismos extraordinarios de supervisión de la medida cautelar sobre el caso, incluyendo el acompañamiento a las familias a cada una de las reuniones que se convoquen desde Presidencia.

2. Se concrete un mecanismo técnico de revisión adicional de los archivos castrenses por parte de la CIDH, requiriendo al Estado que informe por escrito si acepta esta propuesta.

3. Que en cuanto se elija a la próxima Comisionada o Comisionado Relator para México se lleve a cabo una visita al país y en particular a la Normal Rural de Ayotzinapa, para que pueda conocer de primera mano el estatus del caso y encontrarse con las familias.

4. Que la CIDH continúe la supervisión de las medidas cautelares en el caso, sin dejar de estar alerta de posibles acciones legales que se puedan iniciar en contra de las víctimas, representantes y funcionarios públicos que han trabajado por esclarecer el caso en los últimos años.

Frente a estas peticiones, la representación del Estado mexicano se limitó a leer una comunicación enviada por el fiscal del caso, Rosendo Gómez Piedra, en donde se dedicó a denostar el trabajo del anterior titular de la Unidad Especial de Investigación y Litigación para el caso Ayotzinapa (UEILCA), así como de la propia CIDH, y no de presentar las líneas actuales de la investigación. La comunicación, además, contuvo afirmaciones preocupantes como la minimización de los efectos perniciosos de la tortura frente a los procesos penales, que derivaron en la libertad de posibles responsables.

Los padres y madres y organizaciones acompañantes lamentaron esta respuesta ya que se da un mensaje de irrespeto a las familias y de una clara intención de eludir la supervisión internacional sobre este caso, como en otros de desaparición en México.

Asimismo, sobre el desmantelamiento de varios mecanismos establecidos para esclarecer los hechos y responsables en el caso —lo que incluye la salida de GIEI del país por falta de condiciones, la posible criminalización del ex fiscal especializado y la incertidumbre sobre el futuro de la COVAJ—, se señalaron dos razones por esos retrocesos institucionales que efectivamente han devuelto el caso al 2018: la politización de las investigación y el empoderamiento del Ejército.

Las y los comisionados señalaron la ausencia de autoridades claves, lo cual limitó la posibilidad de hacer preguntas concretas sobre dónde está hoy el caso Ayotzinapa, en las responsabilidad de preparación, no sólo de líneas de investigación, sino de acciones dirigidas para completar esas líneas, cómo se ha llevado a cabo las investigaciones de los altos mandos, el proceso de órdenes de aprehensión, el otorgamiento de medidas sustitutivas a la prisión preventiva de figuras importantes, entre otros temas.

“Los familiares de personas desaparecidas también son víctimas y llevan 9 años. Y 9 años de sufrimiento y de espera. Yo tengo que decir con mucha franqueza: una justicia que tarda no es justicia. Es una verdad que se demora, por más que hay explicaciones y valoro que den explicaciones, pero me atrevo a decir que si le preguntan a los solicitantes ‘¿qué están esperando?’, es ‘dónde están sus hijos'”, dijo la comisionada Julissa Mantilla. Al tiempo que la Comisionada Esmeralda Troitiño lamentó estar por concluir su mandato sobre México sin que el caso haya sido esclarecido.

Ante los señalamientos de los padres y madres, las organizaciones acompañantes, y ante los cuestionamientos de la Comisión Interamericana, el Estado se comprometió a dar posteriormente respuestas puntuales; mientras que las y los comisionados se comprometieron a dar seguimiento, como lo han hecho durante estos 9 años, desde que sucedieron los hechos.

Desde comienzos de septiembre, una delegación del Congreso Nacional Indígena y del Centro de Derechos Humanos Fray Bartolomé de las Casas está recorriendo Europa para intercambiar sus dolores, problemáticas y alegrías con otros pueblos del mundo

BARCELONA. – Oscar narra el momento en que una comisión encargada de mapear el territorio indígena de su comunidad preguntó a los abuelos, a los mayores del pueblo, sobre cómo debían cartografiar su territorio. La historia se complica cuando los abuelos les contestaron: “hay que comenzar con la Luna”.

La luna marca muchos de los ciclos vitales, agrícolas y espirituales de las comunidades ¿Puede haber territorio sin luna, sin sol, sin cielo? Una capa que cobija a los pueblos por encima de donde se da la reproducción de la vida, donde se siembra para comer, pero donde los cuerpos también son sembrados al morir.

Conocer las dimensiones de la territorialidad que habitan los pueblos y comunidades indígenas es importante para poder defenderla. Oscar despliega un mapa donde se puede ver la República mexicana atravesada por grandes infraestructuras que cortan el territorio. Desde gasoductos como el Texas-Tuxpan-Tula y su continuación hacia el sureste, hasta las diferentes concesiones mineras agazapadas por todo el país, muchas a la espera del pistoletazo de salida.

Pero también hablan de las fosas clandestinas, de los territorios de exterminio, de los campos de tiro y entrenamiento del crimen organizado infiltrado en el territorio, muchos al amparo de las autoridades locales, donde el crimen no es organizado sino autorizado.

De eso, de su vida, dolores y resistencias, han venido al viejo continente Oscar y Amaidaly para hablar con las organizaciones europeas solidarias con México. Desde comienzos de septiembre, una delegación del Congreso Nacional Indígena (CNI) y del Centro de Derechos Humanos Fray Bartolomé de las Casas viene recorriendo Europa en una primera fase en la que se han reunido con colectivos e instituciones de una veintena de ciudades en siete territorios: Alemania, Austria, Francia, Suiza, Países bajos, Bélgica y Catalunya.

El objetivo principal es compartir los Espejos de dolor y resistencia que viven los pueblos y comunidades indígenas de México, así como dar seguimiento a la visita de la delegación del CNI que acompañó al EZLN en la Gira por la Vida del 2021. En aquella ocasión varios delegados y delegadas tuvieron presencia en algunas de estas mismas ciudades europeas, presagiando lo que hoy es una situación de incremento de violencia ejercida desde varios sectores hacia los territorios de los pueblos.

La entrada del crimen organizado en Chiapas es una de las situaciones más preocupantes. La violencia ejercida hacia la comunidad zapatista de Moisés Gandhi o el cerco que se vive en Frontera Comalapa y Chicomuselo, todas esas noticias que llegan a Europa y se miran con preocupación. La cooptación forzada de comunidades indígenas que son obligadas a trabajar para esos intereses criminales está provocando una degradación social de gran calado. Aunque también hay motivos para la esperanza, como la heroica defensa de la comunidad nahua de Santa María Ostula frente a los ataques por el control de su territorio frente a las pulsiones externas por convertirlo en campo de operaciones de diferentes actores criminales.

Los delegados del CNI comentan que la forma de contener el avance del crimen y del despojo ha sido el poder mantener cohesionada a la comunidad, en su trabajo organizativo para mantenerse unidos, en sus tradiciones y su espiritualidad, con la solidaridad nacional e internacional. Como pasó en Wirikuta, o como ha ocurrido en Cherán y en otras regiones donde los pueblos son los que han detenido el avance del crimen, no las autoridades ni las fuerzas del orden.

Los megaproyectos son un capítulo aparte. La trama de infraestructuras que recuerdan las intenciones del viejo Plan Puebla Panamá sigue siendo una de las principales amenazas de despojo territorial y cultural, si es que puede haber lo uno sin lo otro. Los polos de desarrollo aparejados al Tren Maya o al Transístmico son un goloso botín. Es ingenuo pensar que estas zonas de crecimiento industrial y urbano no terminará devorando territorios de reserva natural y de las comunidades y pueblos indígenas que los habitan.

A su paso por Europa, la delegación también ha tenido oportunidad de solidarizarse con otros pueblos, como las organizaciones de mujeres del Kurdistán, o con la comunidad palestina de Barcelona en una de las concentraciones por el alto a la guerra, frente a la delegación de la Unión Europea en la ciudad. Han entablado contacto con las organizaciones migrantes y su lucha por regularizar su situación frente a la falta de papeles que les dejen existir. La delegación resalta que la resistencia de los pueblos frente al despojo tiene su Espejo también de este lado del mundo y el valor del internacionalismo y la solidaridad entre los pueblos más allá de las geografías.

Por todo esto, el llamado urgente del CNI y del Frayba es para poner la mirada en los procesos de violencia y despojo que han detectado en los más de 45 pueblos, naciones y tribus que conforman el Congreso Nacional Indígena. Analizar las actividades de las empresas transnacionales que pueden ser cómplices directas o indirectas de esta situación. Pero, sobre todo, poder renovar los vínculos que los pueblos indígenas mexicanos han construido con la Europa insumisa Slumil K’ajxemk’op en los 27 años de existencia del CNI, cumplidos justamente el pasado 12 de octubre, Día de la resistencia y dignidad indígena.

SIXTH PART: POSTSCRIPT WHO SEEKS HOPING TO FIND.

Los pueblos indígenas en situación de aislamiento y contacto inicial (PIACI) que habitan en territorios del Perú son amenazados por la expansión de proyectos extractivistas. Desde el Estado y gremios empresariales, se intenta desconocer su existencia para sumar concesiones de infraestructura y explotación de hidrocarburos, minerales y madera.

Se estima que 7,500 indígenas (5,200 sin contacto y 2,250 en contacto inicial), distribuidos en unos 20 pueblos originarios, viven aislados en áreas remotas de la Amazonía peruana.
Para su protección, en 2006 se promulgó la Ley 28736 (Ley PIACI), que dispone la creación de reservas en zonas de asentamiento temporal y tránsito de las comunidades nómadas.

Se trata de la única norma que los resguarda en las ocho naciones suramericanas que comparten la selva amazónica, donde se tiene referencias de 114 pueblos aislados, de las cuales 60 han sido confirmadas, según el Observatorio Regional Amazónico.

Desde entonces se crearon dos reservas para pueblos en aislamiento. De otras cinco planificadas con este objetivo, solo dos son adecuadas para las comunidades indígenas. Otras seis se encuentran en la etapa de solicitud.

En comparación con la experiencia reciente en Ecuador del “Sí” al Parque Nacional Yasuní, una histórica consulta popular que rechazó la actividad petrolera que afecta a la reserva, habitada por pueblos transfronterizos, “existe una gran diferencia en cuanto a la batería de acciones legales y campañas políticas activadas en el lado peruano”, observan Guisela Loayza y Eduardo Pichilingue, de la alianza Cuencas Sagradas.

La Secretaría de Comunicaciones y Transporte inició una denuncia penal por el delito de ataque a las vías de comunicación contra el indígena binnizá, David Hernández Salazar, quien lucha contra la construcción de un parque industrial del Corredor Interoceánico en su comunidad Puente Madera, municipio de San Blas Atempa, en el Istmo de Tehuantepec, Oaxaca. La notificación ocurrió el 18 de octubre de 2023.

La denuncia fue interpuesta ante la Fiscalía General de la República por la representación legal de la Secretaría. En dicha notificación requieren la comparecencia del defensor de derechos humanos para el desahogo de la audiencia inicial el día 1 de diciembre de 2023. Hasta el momento, el defensor y sus representantes legales no tuvieron mas información sobre los hechos a los que se refiere la denuncia, informan las organizaciones de derechos humanos Front Line Defenders y la RED TDT.

Salazar, que hace parte de la Asamblea de los Pueblos Indígenas del Istmo en Defensa de la Tierra y el Territorio (APIIDTT), enfrenta otra denuncia penal por parte del Municipio de San Blas Atempa y por particulares. La denuncia se encuentra en la Vicefiscalía Regional del Istmo ubicada en Tehuantepec.

El pasado domingo (5), el Ejército Zapatista de Liberación Nacional (EZLN), a través del cuarto comunicado difundido durante el último mes, tras meses sin declaraciones oficiales, anunció la desaparición de los Municipios Autónomos Rebeldes Zapatistas (MAREZ), así como las Juntas de Buen Gobierno (JBG).

El documento, firmado por el Subcomandante Insurgente Moisés, afirma que la decisión de los pueblos zapatistas se “realiza después de un largo y profundo análisis crítico y autocrítico”, así como tras consultar a las comunidades autónomas de Chiapas.

En consecuencia, el EZLN comunicó la invalidez de todos los sellos, membretes, cargos, representaciones y futuros acuerdos con cualquier MAREZ o JBG; los acuerdos sostenidos antes de esta fecha se mantendrán hasta el final de su vigencia . También compartieron que los Caracoles permanecerán cerrados al exterior hasta nuevo aviso.

“Las razones y el proceso por el que se tomó esta decisión se las iremos platicando poco a poco en los escritos siguientes. Sólo les adelanto que esta valoración, en su fase final, se inició hace unos 3 años. También les iremos explicando cómo es y cómo se ha ido gestando la nueva estructura de la autonomía zapatista”, contextualiza el vocero zapatista.

Chiapas: completo caos

El vocero zapatista detalla que las principales ciudades de Chiapas viven “en un completo caos. Las presidencias municipales están ocupadas por lo que nosotros llamamos ‘sicarios legales’ o ‘Crimen Desorganizado’. Hay bloqueos, asaltos, secuestros, cobro de piso, reclutamiento forzado, balaceras. Esto es efecto del padrinazgo del gobierno del estado y la disputa por los cargos que está en proceso. No son propuestas políticas las que se enfrentan, sino sociedades criminales”, asevera el comunicado.

Fourth Part and First Approach Alert.
Several Necessary Deaths.

To the people who subscribe the Declaration for Life:

We inform you of the following:

FIRST. – A few months ago, after a long and profound critical and self-critical analysis, and after consulting all the Zapatista towns, it was decided to disappear the Zapatista Rebel Autonomous Municipalities (MAREZ) and the Good Government Juntas.

SECOND. – All seals, letterheads, positions, representations and agreements with the name of any MAREZ or any of the Good Government Juntas are invalid from this moment on. No person can present themselves as a member, authority or representative of any MAREZ or Good Government Junta. The agreements held before this date, with Non-Governmental Organizations, social organizations, collectives, solidarity groups and instances in Mexico and the world are maintained until their expiration, but new agreements cannot be made with these bodies of Zapatista autonomy, for the simple reason that they no longer exist.

THIRD. – The Caracoles remain, but they will remain closed to the outside world until further notice.

FOURTH. – We will tell you the reasons and process by which this decision was made little by little in the following texts. I can only tell you that this evaluation, in its final phase, began about 3 years ago. We will also explain to you what the new structure of Zapatista autonomy is like and how it has been developing.

All that, and more things, will appear at the right time.

FIFTH. – We inform you that we will hold a celebration to mark the 30th anniversary of the beginning of the war against oblivion. This, in the months of December 2023 and January 2024. All people who signed the “Declaration for Life” are invited.

However, it is our duty, while inviting you, to discourage you. Contrary to what the official press, self-proclaimed cool-progre-chill, reports and misinforms, the main cities of the southeastern Mexican state of Chiapas are in complete chaos. The municipal presidencies are occupied by what we call “legal hitmen” or “Disorganized Crime.” There are blockades, assaults, kidnappings, “cobro de piso”, forced recruitment, shootings. This is the effect of the protection of the state government and the dispute over the political charges that is in process. What is being confronted are not political proposals, but rather criminal societies.

So, of course we tell you that, unlike other years, it is not safe.

San Cristóbal de las Casas, Comitán, Las Margaritas and Palenque, to mention some municipal seats, are in the hands of one of the disorganized crime cartels and in dispute with another. This is confirmed by the so-called hotel, tourism, restaurant and service industries. Those who work in these places know this and have not reported it because they are threatened and, furthermore, because they know that any request is useless, because the state and municipal authorities are the ones who commit crimes and know no limit in the robbery they are doing.

In rural communities the problem is even more serious. This is what is being shouted by those who live in all the regions of Chiapas, particularly in the entire border strip with Guatemala.

What is read, heard and seen in the majority of local and national media is just a bad and shameless echo of the state government’s social networks. The truth is that the official authorities are the problem. Yes, like in the rest of the country.

Federal, state and local military and police forces are not in Chiapas to protect the civilian population. They have the sole purpose of stopping migration. That is the order that came from the North American government. As is their way, they have turned migration into a business. Human trafficking is a business of the authorities who, through extortion, kidnapping and buying and selling of migrants, shamelessly enrich themselves.

So, we do not advise you to come. Unless, of course, you organize yourselves very well to do so.

So, although we are not waiting for you, we are inviting you. The tentative dates of the commemorations are between December 23, 2023 and January 7, 2024, the central celebration being December 30-31 and January 1-2. We will tell you the place afterwards. That is to say, we do want you to come, although we don’t recommend it.

Even if you don’t arrive, don’t worry. We will still send you photos and videos.

Well, that is if there still is a world in those dates, anyway.
